(GECP).<\/b><\/p>\n<h2><span style=\"font-size: 18pt;\"><b>More on News:\u00a0\u00a0<\/b><\/span><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Emphasizing the need to treat children with care and respect, the <\/span><b>Madras High Court has recently deprecated the practice of imposing corporal punishment on children.<\/b><\/li>\n<\/ul>\n<table style=\"width: 100.099%;\">\n<tbody>\n<tr>\n<td style=\"width: 100%; border-style: solid; border-color: #000000; background-color: #b8a5d987;\"><span style=\"color: #000000;\"><b>About Guidelines issued by Tamil Nadu:<\/b><\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"color: #000000;\"><b>Safeguarding the mental well-being &#038; Conducting Awareness: <\/b><span style=\"font-weight: 400;\">The GECP, jointly issued by the Director of School Education and the Director of Elementary Education includes safeguarding the mental well-being of students and conducting awareness camps to familiarise stakeholders with guidelines of the National Commission for Protection of Child Rights (NCPCR) for effective implementation.<\/span><\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"color: #000000;\"><b>Take Proactive Steps:<\/b><span style=\"font-weight: 400;\"> The Tamil Nadu School Education Department has instructed district-level officers to ensure that all schools in their jurisdiction take proactive steps<\/span><b> to create safe and nurturing environments for students.<\/b><\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"color: #000000;\"><b>Extending the focus beyond Eliminating Corporal Punishment: <\/b><span style=\"font-weight: 400;\">To address any form of harassment or situations impacting students\u2019 mental health and <\/span><b>establish monitoring committees <\/b><span style=\"font-weight: 400;\">at each school comprising school heads, parents, teachers and senior students to oversee the implementation of guidelines and address any issues.<\/span><\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"color: #000000;\"><b>Affirmative Actions: <\/b><span style=\"font-weight: 400;\">The Department also<\/span><b> listed several affirmative actions against corporal punishment, <\/b><span style=\"font-weight: 400;\">including addressing difficult situations, positive engagement with children, focus on help and not punishment, rights of the teaching community and children, multidisciplinary intervention, life-skills education, creating a positive environment and mechanisms for children\u2019s voices.<\/span><\/span><\/li>\n<\/ul>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<h2><span style=\"font-size: 18pt;\"><b>About Corporal Punishment:<\/b><\/span><\/h2>\n<ul>\n<li><b>Refers: <\/b><span style=\"font-weight: 400;\">According to the <\/span><b>Right to Education (RTE) Act, 2009, <\/b><span style=\"font-weight: 400;\">corporal punishment includes <\/span><b>physical punishment, mental harassment and discrimination.<\/b><span style=\"font-weight: 400;\">\u00a0<\/span>\n<ul>\n<li><span style=\"font-weight: 400;\">There is<\/span><b> no statutory definition <\/b><span style=\"font-weight: 400;\">of \u2018corporal punishment\u2019 targeting children in India.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">However, the<\/span><b> RTE Act, 2009 prohibits <\/b><span style=\"font-weight: 400;\">\u2018physical punishment\u2019 and \u2018mental harassment\u2019 <\/span><b>under Section 17(1)<\/b><span style=\"font-weight: 400;\"> and makes it <\/span><b>a punishable offence under Section 17(2).<\/b><\/li>\n<\/ul>\n<\/li>\n<li><b>Classification:<\/b><span style=\"font-weight: 400;\"> Corporal Punishment can be broadly classified into two types:<\/span>\n<ul>\n<li><b>Physical punishment: <\/b><span style=\"font-weight: 400;\">According to the National Commission for Protection of Child Rights (NCPCR), physical punishment is any action that <\/span><b>causes pain, hurt\/injury and discomfort <\/b><span style=\"font-weight: 400;\">to a child.<\/span>\n<ul>\n<li><b>Examples:<\/b><span style=\"font-weight: 400;\"> Standing on bench, standing against the wall in a chair-like position, standing with school bag on head, holding ears through legs, kneeling, forced ingestion of anything, detention in the classroom, library, toilet, etc.<\/span><\/li>\n<\/ul>\n<\/li>\n<li><b>Mental Harassment: <\/b><span style=\"font-weight: 400;\">It is any non-physical treatment that is detrimental to the<\/span><b> academic and psychological well-being<\/b><span style=\"font-weight: 400;\"> of a child.<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"3\"><b>Examples:<\/b><span style=\"font-weight: 400;\"> It includes sarcasm, calling names and scolding using humiliating adjectives, intimidation, using derogatory remarks for the child, ridiculing or belittling a child, shaming the child, etc.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h2><span style=\"font-size: 18pt;\"><b>Regulations for Protection against Corporal Punishment:<\/b><\/span><\/h2>\n<ul>\n<li aria-level=\"1\"><b>Constitutional Provisions:<\/b>\n<ul>\n<li><b>Article 21 A:<\/b><span style=\"font-weight: 400;\"> Provision for <\/span><b>compulsory education<\/b><span style=\"font-weight: 400;\"> in the age group of 6-14.<\/span><\/li>\n<li><b>Article 24: <\/b><span style=\"font-weight: 400;\">It <\/span><b>prohibits child labor<\/b><span style=\"font-weight: 400;\"> in hazardous work until the age of 14.<\/span><\/li>\n<li><b>Article 39 (e): <\/b><span style=\"font-weight: 400;\">It is the <\/span><b>duty of the state<\/b><span style=\"font-weight: 400;\"> to ensure that children are not abused due to economic disparity.<\/span><\/li>\n<li><b>Article 45:<\/b><span style=\"font-weight: 400;\"> It is the <\/span><b>duty of the state<\/b><span style=\"font-weight: 400;\"> to provide for the <\/span><b>care of children in the age group of 0-6.<\/b><\/li>\n<li><b>Article 51A(k):<\/b><span style=\"font-weight: 400;\"> It is the<\/span><b> fundamental duty<\/b><span style=\"font-weight: 400;\"> of parents to<\/span><b> ensure that their child receives education for the age group of 6 to 14.<\/b><\/li>\n<\/ul>\n<\/li>\n<li aria-level=\"1\"><b>The National Commission for Protection of Child Rights (NCPCR) Guidelines:\u00a0<\/b>\n<ul>\n<li><span style=\"font-weight: 400;\">The NCPCR provides <\/span><b>guidelines<\/b><span style=\"font-weight: 400;\"> for eliminating corporal punishment.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\">It includes <\/span><b>promoting positive engagement<\/b><span style=\"font-weight: 400;\"> with children and <\/span><b>establishing Corporal Punishment Monitoring Cells <\/b><span style=\"font-weight: 400;\">in every school to ensure compliance with anti-corporal punishment measures.<\/span><\/li>\n<li><b>Drop boxes <\/b><span style=\"font-weight: 400;\">are to be placed where the aggrieved person may drop his complaint and anonymity is to be maintained to protect privacy.<\/span><\/li>\n<\/ul>\n<\/li>\n<li><b>Right of Children to Free and Compulsory Education (RTE) Act 2009:<\/b>\n<ul>\n<li><b>Section 17<\/b><span style=\"font-weight: 400;\">: It imposes<\/span><b> an absolute bar<\/b><span style=\"font-weight: 400;\"> on corporal punishment.<\/span>\n<ul>\n<li><span style=\"font-weight: 400;\">It<\/span><b> prescribes disciplinary action <\/b><span style=\"font-weight: 400;\">to be taken against the guilty person.<\/span><\/li>\n<\/ul>\n<\/li>\n<li><b>Sections 8 and 9<\/b><span style=\"font-weight: 400;\">: It places<\/span><b> a duty <\/b><span style=\"font-weight: 400;\">on the appropriate Government and the local authority<\/span> <span style=\"font-weight: 400;\">to ensure that the child belonging to weaker sections and the disadvantaged group are not discriminated against and prevented from pursuing and completing elementary education on any grounds.<\/span><\/li>\n<li><b>Organisations to curb Corporal Punishment:\u00a0<\/b>\n<ul>\n<li><b>National Commission for Protection of Child Rights and State Commissions for Protection of Child Rights <\/b><span style=\"font-weight: 400;\">to ensure that the children are being treated in consonance with the RTE Act, 2009.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<li aria-level=\"1\"><b>Juvenile Justice\u00a0 (Care and Protection of Children) Act, 2000:<\/b>\n<ul>\n<li><b>Section 23: <\/b><span style=\"font-weight: 400;\">Cruelty to children is also prohibited.<\/span>\n<ul>\n<li><span style=\"font-weight: 400;\">Any person who is in control of a juvenile and who abandons, assaults, exposes or wilfully neglects the juvenile or procures him to be abandoned, assaulted, exposed or neglected which in turn causes mental or physical pain to him\/her shall be punished with imprisonment up to<\/span><b> six months, or fine, or with both.<\/b><\/li>\n<\/ul>\n<\/li>\n<li><b>Section 75:<\/b><span style=\"font-weight: 400;\"> It prescribes<\/span><b> punishment for cruelty <\/b><span style=\"font-weight: 400;\">to children.<\/span><\/li>\n<\/ul>\n<\/li>\n<li><b>United Nations Convention on the Rights of Child (UNCRC), 1989:<\/b>\n<ul>\n<li><b>Article 19:<\/b><span style=\"font-weight: 400;\"> It declares that <\/span><b>any form of discipline involving violence is unacceptable.<\/b><span style=\"font-weight: 400;\">\u00a0<\/span>\n<ul>\n<li><span style=\"font-weight: 400;\">It lays down that <\/span><b>children have the right to be protected from being hurt and mistreated, <\/b><span style=\"font-weight: 400;\">physically or mentally.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<li><b>Indian Penal Code:<\/b>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><b>Section 305:<\/b><span style=\"font-weight: 400;\"> It is pertaining to abetment of <\/span><b>suicide committed by a child<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><b>Section 323: <\/b><span style=\"font-weight: 400;\">It is pertaining to <\/span><b>voluntarily causing hurt.<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><b>Section 325: <\/b><span style=\"font-weight: 400;\">It is about<\/span><b> voluntarily causing grievous hurt.<\/b><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h2><span style=\"font-size: 18pt;\"><b>Concerns of Corporal Punishment:<\/b><\/span><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Violation to Fundamental Right:<\/b><span style=\"font-weight: 400;\"> Corporal Punishment is anti-Constitutional as it violates the right to live with dignity, an integral part of the Right to Life under Article 21 of the Indian Constitution.<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">It is also against the Right to Education, which is a fundamental right under Article 21A.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">It is against the <\/span><b>Article 37 (a) of the UNCRC<\/b><span style=\"font-weight: 400;\"> to which India is a signatory, says that no child should bear any torture, cruelty, or inhuman punishment.\u00a0<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Physical &#038; Psychological Concerns:<\/b><span style=\"font-weight: 400;\"> Corporal Punishment can cause<\/span><b> physical injuries, anxiety, low self-esteem, and other mental health issues.<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Violence:<\/b><span style=\"font-weight: 400;\"> Corporal Punishment may normalize and perpetuate violence in society.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Discrimination: <\/b><span style=\"font-weight: 400;\">Corporal Punishment may be applied disproportionately or discriminatorily based on factors such as gender, race, or socioeconomic status.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Impact on Education:<\/b><span style=\"font-weight: 400;\"> Corporal Punishment can lead to higher school dropout rates and poor learning outcomes due to the atmosphere of fear and intimidation it creates in classrooms.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Scarred for Life: <\/b><span style=\"font-weight: 400;\">Corporal Punishment can mean long-term trauma for sensitive children and scar them for life.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Various Negative Outcomes:<\/b><span style=\"font-weight: 400;\"> Such as behavioural problems, occurred irrespective of the child&#8217;s sex, race, or ethnicity and regardless of the overall teaching styles of the caregivers.\u00a0<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">The magnitude of negative outcomes for children increased with the frequency of physical punishment. The physical punishment does not improve children&#8217;s behaviour and instead makes it worse.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<table style=\"width: 100.3%;\">\n<tbody>\n<tr>\n<td style=\"width: 100%; border-style: solid; border-color: #000000; background-color: #b8a5d987;\"><span style=\"color: #000000;\"><b>S. Jai Singh and Ors. vs State and Anr, 2018:<\/b><\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #000000;\">This case relates to a student who died after he was made to do a &#8220;duck-walk&#8221; (a form of Corporal punishment) for arriving late to school.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #000000;\">The judiciary said that despite legislation against such forms of punishment, they are still practiced in educational institutions across the nation.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #000000;\">The judiciary said even animals are protected against cruelty, and our children surely cannot be worse off than animals.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #000000;\">The attitude of the Judiciary is also ambivalent towards the deep-rooted problem of Corporal punishment.<\/span><\/li>\n<\/ul>\n<p><span style=\"color: #000000;\"><b>Thinkers on Corporal Punishments:<\/b><\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"color: #000000;\"><b>Mahatma Gandhi:<\/b><span style=\"font-weight: 400;\"> He opposed corporal punishment, advocated for nonviolent methods of discipline and education.<\/span><\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"color: #000000;\"><b>Rabindranath Tagore:<\/b><span style=\"font-weight: 400;\"> He condemned corporal punishment, believed in nurturing individual creativity and moral development through positive reinforcement.<\/span><\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"color: #000000;\"><b>Maria Montessori: <\/b><span style=\"font-weight: 400;\">She advocated against corporal punishment, and promoted child-centered education focused on nurturing independence and self-discipline.<\/span><\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"color: #000000;\"><b>Jean-Jacques Rousseau: <\/b><span style=\"font-weight: 400;\">He opposed corporal punishment, believed in the natural goodness of children and the importance of freedom in education.<\/span><\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"color: #000000;\"><b>John Dewey: <\/b><span style=\"font-weight: 400;\">He criticized corporal punishment, and emphasized experiential learning and democratic principles in education.<\/span><\/span><\/li>\n<\/ul>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p>\u00a0<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Context: Recently, the Tamil Nadu School Education Department has issued Guidelines for the Elimination of Corporal Punishment in Schools (GECP).
