400;\"> and extend government benefits to the country&#8217;s most distant areas, therefore improving the quality of life.<\/span><\/p>\n<h2><span style=\"font-size: 18pt;\"><strong>Background of Indian Post Office Act 2023<\/strong><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Recently, the Post Office Act of 2023 replaced the<\/span><b> Indian Post Office Act of 1898.<\/b><span style=\"font-weight: 400;\"> This legislative update aims to <\/span><b>streamline regulations,<\/b><span style=\"font-weight: 400;\"> making citizen services, banking, and access to government scheme benefits more straightforward and efficient.<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Law Commission Report:<\/b><span style=\"font-weight: 400;\"> In its<\/span><b> 38th report on the Indian Post Office Act, 1898,<\/b><span style=\"font-weight: 400;\"> the Law Commission highlighted concerns regarding the broad grounds for interception based on &#8216;public emergency&#8217;, which are <\/span><b>not explicitly defined in the act, p<\/b><span style=\"font-weight: 400;\">otentially limiting citizens&#8217; Right to Privacy as outlined in the<\/span><b> Puttaswamy Case.<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Recommendation of Law Commission: <\/b><span style=\"font-weight: 400;\">The <\/span><a href=\"https:\/\/pwonlyias.com\/stage\/upsc-notes\/law-commission-of-india\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Law Commission<\/span><\/a><span style=\"font-weight: 400;\"> recommended that Parliament amend i<\/span><b>nterception laws to align them with the Constitution.<\/b>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">This recommendation resulted in the enactment of the <\/span><b>Telegraph (Amendment) Act of 1981<\/b><span style=\"font-weight: 400;\">, which granted the executive limited authority for interception.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Indian Post Office (Amendment) Bill, 1986: <\/b><span style=\"font-weight: 400;\">However, Parliament approved the <\/span><b>Indian Post Office (Amendment) Bill, 1986<\/b><span style=\"font-weight: 400;\">, which empowered the executive to<\/span><b> intercept or detain postal articles in the national interest.\u00a0<\/b>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">This allowed th<\/span><b>e Union or State Government <\/b><span style=\"font-weight: 400;\">and authorised officers to take such actions under certain circumstances, <\/span><b>including situations of public emergency.<\/b><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Pocket Veto Case<\/b><span style=\"font-weight: 400;\">: Despite Parliament passing the bill, it did not come into force because Former <\/span><b>President Zail Singh <\/b><span style=\"font-weight: 400;\">neither gave assent to it nor returned it to Parliament for reconsideration.<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">This incident became a famous case of a <\/span><b>pocket veto <\/b><span style=\"font-weight: 400;\">and highlighted presidential activism in <\/span><b>India&#8217;s constitutional history.<\/b><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p style=\"text-align: center;\"><span class=\"vc_button\"><a aria-level=\"1\"><b>Postal Stamp Issuance:<\/b><span style=\"font-weight: 400;\"> The regulation grants exclusive authority to India Post for <\/span><b>issuing postage <\/b><span style=\"font-weight: 400;\">stamps.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Services: <\/b><span style=\"font-weight: 400;\">The <\/span><b>Post Office Act 2023 <\/b><span style=\"font-weight: 400;\">stipulates that India Post will offer services as <\/span><b>prescribed by the central government.<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Authority to Intercept<\/b><span style=\"font-weight: 400;\">: Authorised officers appointed by the central government may <\/span><b>intercept postal articles<\/b><span style=\"font-weight: 400;\"> based on reasons such as state security, friendly foreign relations, public order, emergencies, public safety, o<\/span><b>r violations of the Act or other laws.<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Examination of Parcel:<\/b><span style=\"font-weight: 400;\"> Under the Post Office Act 2023, if suspicion arises, the central government<\/span><b> may authorise an India Post officer <\/b><span style=\"font-weight: 400;\">to deliver the postal article to customs or another designated authorit<\/span><b>y, which will handle the item accordingly.<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Regulation of Private courier services:<\/b><span style=\"font-weight: 400;\"> The <\/span><b>Post Office Act 2023, <\/b><span style=\"font-weight: 400;\">for the first time, regulates <\/span><b>private courier services by bringing it<\/b><span style=\"font-weight: 400;\"> under its ambit.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Exemption from Liability: <\/b><span style=\"font-weight: 400;\">The post office and its officials are not held accountable for loss, <\/span><b>misdelivery, delay, or damage in<\/b><span style=\"font-weight: 400;\">curred during postal services, unless specified by government regulations.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Recovery of Unpaid Postal Service Charges as Land Revenue<\/b><span style=\"font-weight: 400;\">: Person using the postal services <\/span><b>will have to pay charges for the services.<\/b><span style=\"font-weight: 400;\"> If the person does not pay these charges because of any reason, the due charges can be <\/span><b>recovered as land revenue.\u00a0<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Appointment of Director General: <\/b><span style=\"font-weight: 400;\">The appointment of a<\/span><b> Director General <\/b><span style=\"font-weight: 400;\">includes the authority to create <\/span><b>regulations governing all essential activities <\/b><span style=\"font-weight: 400;\">related to postal service provision.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Ending Centre\u2019s Exclusive Privilege:<\/b><span style=\"font-weight: 400;\"> The current Act has repealed <\/span><b>Section 4 of the 1898 Act, <\/b><span style=\"font-weight: 400;\">which granted the C<\/span><b>entre the sole right to convey all letters by post<\/b><span style=\"font-weight: 400;\">. Nevertheless, courier services have circumvented the 1898 Act by categorising their deliveries as &#8220;documents&#8221; and <\/span><b>&#8220;parcels&#8221; rather than &#8220;letters&#8221;.<\/b><\/li>\n<\/ul>\n<h2><span style=\"font-size: 18pt;\"><strong>Challenges Associated with the Post Office Act 2023<\/strong><\/span><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Conflict of Interest in Liability Exemption: <\/b><span style=\"font-weight: 400;\">The Post Office Act 2023 <\/span><b>exempts India Post <\/b><span style=\"font-weight: 400;\">from liability for postal service failures, with liability determined by rules set by the central government, which also oversees India Post.
