{"id":125727,"date":"2024-08-10T19:43:19","date_gmt":"2024-08-10T14:13:19","guid":{"rendered":"https:\/\/pwonlyias.com\/stage\/?post_type=current-affairs&#038;p=125727"},"modified":"2024-08-10T19:43:19","modified_gmt":"2024-08-10T14:13:19","slug":"privilege-motion-committee","status":"publish","type":"current-affairs","link":"https:\/\/pwonlyias.com\/stage\/current-affairs\/privilege-motion-committee","title":{"rendered":"Privilege Motion"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">Recently, a notice was submitted to<\/span><b> initiate privilege proceedings in the Rajya Sabha<\/b><span style=\"font-weight: 400;\"> against the Union Education Minister for allegedly <\/span><b>\u201cmisleading\u201d the house on the issue of \u2018dropping\u2019 the Preamble to the Constitution from certain NCERT textbooks.<\/b><\/p>\n<ul>\n<li aria-level=\"1\"><b>Privilege Motion:<\/b> <span style=\"font-weight: 400;\">A privilege motion is a <\/span><b>formal notice submitted by a Member of Parliament (MP) or a Member of the Legislative Assembly (MLA) <\/b><span style=\"font-weight: 400;\">alleging a breach of parliamentary privileges.\u00a0<\/span>\n<ul>\n<li><span style=\"font-weight: 400;\">This occurs when a member&#8217;s rights and immunities, which are essential for the effective discharge of their duties, are disregarded.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Such instances are considered offences known as <\/span><b>&#8216;breach of privilege,<\/b><span style=\"font-weight: 400;\">&#8216; and are<\/span><b> punishable under the laws of Parliament.<\/b><\/li>\n<\/ul>\n<\/li>\n<li aria-level=\"1\"><b>Who Can Move a Privilege Motion?<\/b>\n<ul>\n<li><b>Any Member:<\/b><span style=\"font-weight: 400;\"> Both <\/span><b>MPs in Lok Sabha<\/b><span style=\"font-weight: 400;\"> and <\/span><b>MLAs in State Assemblies <\/b><span style=\"font-weight: 400;\">can move a privilege motion.<\/span><\/li>\n<\/ul>\n<\/li>\n<li><b>Procedure:<\/b>\n<ul>\n<li><span style=\"font-weight: 400;\">The motion must involve a <\/span><b>recent incident that the member considers a breach of privilege.<\/b><\/li>\n<li><b>Notices must be submitted before 10 am to the Speaker or Chairperson of the House.<\/b><\/li>\n<li><b>The member must seek consent from the Speaker (Lok Sabha) or Chairperson (Rajya Sabha) to raise the issue.<\/b><\/li>\n<\/ul>\n<\/li>\n<li><b>Role of the Lok Sabha Speaker and Rajya Sabha Chairperson<\/b><\/li>\n<li aria-level=\"1\"><b>Initial Scrutiny: <\/b><span style=\"font-weight: 400;\">The Speaker and Chairperson are responsible for the<\/span><b> first level of scrutiny of a privilege motion.<\/b>\n<ul>\n<li><span style=\"font-weight: 400;\">They may <\/span><b>either decide on the motion themselves or refer it to the Privileges Committee.<\/b><\/li>\n<\/ul>\n<\/li>\n<li><b>Consent and Explanation: <\/b><span style=\"font-weight: 400;\">Upon giving consent under Rule 222, <\/span><b>the concerned member is allowed to explain their case.<\/b><\/li>\n<\/ul>\n<p style=\"text-align: center;\"><span class=\"vc_button\"><a href=\"https:\/\/www.pw.live\/batches\/upsc?utm_source=seo+upsc+batch&#038;utm_medium=seo+upsc&#038;utm_campaign=seo&#038;utm_id=upsc\" target=\"_blank\" rel=\"noopener\">Enroll now for UPSC Online Course<\/a><\/span><\/p>\n<h2><span style=\"font-size: 18pt;\"><b>Privileges Committee<\/b><\/span><\/h2>\n<ul>\n<li><b>Composition: <\/b><span style=\"font-weight: 400;\">The Lok Sabha committee has 15 members, while the Rajya Sabha committee has 10 members.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">In the Rajya Sabha, the deputy chairperson heads the committee of privileges<\/span><\/li>\n<li><b>Function: The committee investigates the breach of privilege and submits a report to the House for consideration.<\/b><\/li>\n<\/ul>\n<table style=\"width: 100.101%;\">\n<tbody>\n<tr>\n<th style=\"width: 100%; border-style: solid; border-color: #000000; background-color: rgba(184, 165, 217, 0.53); text-align: left; vertical-align: middle;\">\n<h3><span style=\"font-size: 16pt; color: #000000;\"><strong>Parliamentary Privileges<\/strong><\/span><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">Parliamentary privileges are <\/span><b>special rights, immunities and exemptions<\/b><span style=\"font-weight: 400;\"> enjoyed by the two Houses of Parliament, their committees and their members.<\/span><\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">The Constitution<\/span><b> also extends the parliamentary privileges to those persons who are entitled to speak and take part in the proceedings of a House of Parliament or any of its committees<\/b><span style=\"font-weight: 400;\">. These include the<\/span><b> Attorney General of India and Union ministers<\/b><span style=\"font-weight: 400;\">.<\/span><\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">The parliamentary privileges<\/span><b> do not extend to the President <\/b><span style=\"font-weight: 400;\">who is also <\/span><b>an integral part of the Parliament<\/b><span style=\"font-weight: 400;\">. <\/span><b>Article 361<\/b><span style=\"font-weight: 400;\"> of the Constitution provides for privileges for the President.<\/span><\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"color: #000000;\"><b>Article 105<\/b><span style=\"font-weight: 400;\"> of the Constitution expressly mentions <\/span><b>two privileges<\/b><span style=\"font-weight: 400;\">, that is,<\/span><b> freedom of speech in Parliament and right of publication of its proceedings.<\/b><\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">Apart from the <\/span><b>privileges as specified in the Constitution<\/b><span style=\"font-weight: 400;\">, the <\/span><b>Code of Civil Procedure, 1908<\/b><span style=\"font-weight: 400;\">, provides for freedom from arrest and detention of members under civil process during the continuance of the meeting of the House or of a committee thereof and forty days before its commencement and forty days after its conclusion.<\/span><\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;
