aria-level=\"1\"><b>Judgment:<\/b><span style=\"font-weight: 400;\"> The Bench was hearing the plea <\/span><b>challenging a Trial Court order that refused to give the petitioner visitation rights<\/b><span style=\"font-weight: 400;\"> and access to the twin daughters born through surrogacy.\u00a0<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">The judgment n<\/span><b>oted that the lower Court Order denying visitation rights to the petitioner was without proper application of mind.\u00a0<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">The Bench <\/span><b>granted visitation rights and access to the twin daughters to the petitioner.\u00a0\u00a0\u00a0<\/b><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Judgement<\/span><b> referred to the National Guidelines for Accreditation, Supervision, and Regulation of ART (Assisted Reproductive Technology) clinics in India, enacted in 20<\/b><span style=\"font-weight: 400;\">05 in its order.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Argument:<\/b><span style=\"font-weight: 400;\"> The woman (petitioner\u2019s sister) argued that she had a legitimate right over the twins as their biological parent.<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">The women volunteered to donate her oocyte (eggs) for her sister and brother-in-law who style=\"font-weight: 400;\" aria-level=\"1\"><b>Procedure:<\/b><span style=\"font-weight: 400;\"> The ART procedures<\/span><b> involve surgically removing eggs from a woman\u2019s ovaries,<\/b><span style=\"font-weight: 400;\"> combining them with sperm in the laboratory, and returning them to the woman\u2019s body or donating them to another woman through surrogacy.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Exclusion: <\/b><span style=\"font-weight: 400;\">ART technologies does not include treatments<\/span><b> where only sperms are handled i.e., intrauterine or artificial insemination <\/b><span style=\"font-weight: 400;\">or procedures in which a woman takes medicine only to stimulate egg production without the intention of having eggs retrieved.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>The First ART Treatment:<\/b><span style=\"font-weight: 400;\"> The first successful in vitro fertilization (IVF) treatment was<\/span><b> carried out on humans in 1978 in England<\/b>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><b>ART in India: India\u2019s first IVF baby, Kanupriya alias Durga, <\/b><span style=\"font-weight: 400;\">was born in Calcutta on October 3, 1978, is also the <\/span><b>world\u2019s second IVF baby born<\/b><span style=\"font-weight: 400;\"> only two months after the world\u2019s first IVF baby, Louise Brown.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Use: <\/b><span style=\"font-weight: 400;\">In Vitro Fertilisation
