of the PCA.<\/b><\/span><\/li>\n<\/ul>\n<\/th>\n<\/tr>\n<\/tbody>\n<\/table>\n<ul>\n<li><b>Types of Arbitration:<\/b>\n<ul>\n<li><b>Ad hoc Arbitration: <\/b><span style=\"font-weight: 400;\">Parties opting the Ad- hoc arrangement are <\/span><b>free to agree to existing ad hoc rules (e.g. the UNCITRAL Arbitration Rules)<\/b><span style=\"font-weight: 400;\"> or establish their own rules of procedure and to tailor the procedure to their needs.<\/span><\/li>\n<li><b>Institutional Arbitration: <\/b><span style=\"font-weight: 400;\">Each institutions has their own <\/span><b>model form of arbitration clause<\/b><span style=\"font-weight: 400;\"> that may be incorporated into the main contract with the institution also with its own set of arbitral rules that will apply to the arbitrations it administers.\u00a0<\/span>\n<ul>\n<li><b>Example: The International Chamber of Commerce (ICC); The International Centre for Dispute Resolution (ICDR); Singapore International Arbitration Centre (SIAC); London Court of International Arbitration (LCIA); Permanent Court of Arbitration (PCA)<\/b><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<li aria-level=\"1\"><b>Features:\u00a0<\/b>\n<ul>\n<li><b>Enforceable:<\/b>\n<ul>\n<li><span style=\"font-weight: 400;\">Over 170 countries have ratified the <\/span><b>New York Convention (Convention on the Recognition and Enforcement of Foreign Arbitral Awards of 1958) including India, <\/b><span style=\"font-weight: 400;\">enabling them to recognize and enforce international arbitration awards\u00a0<\/span>\n<ul style=\"list-style-type: disc;\">\n<li><span style=\"font-weight: 400;\">The Government of India is a <\/span><b>signatory to the New York Convention as well as signed agreements for mutual cooperation in arbitration<\/b><span style=\"font-weight: 400;\"> with various countries enabling cross-border resolution of disputes.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<li><b>Neutrality:<\/b>\n<ul>\n<li><span style=\"font-weight: 400;\">International arbitration provides a neutral forum for resolving cross-border disputes as the<\/span><b> domestic judicial system may be unfamiliar, complex and a challenge to navigate for the parties.\u00a0<\/b><\/li>\n<\/ul>\n<\/li>\n<li><b>Privacy and Confidentiality:<\/b>\n<ul>\n<li><span style=\"font-weight: 400;\">The submissions, rulings, and orders of the international arbitral tribunal\u00a0 are <\/span><b>communicated only to the parties and generally not made public.<\/b><span style=\"font-weight: 400;\"> The parties can also put on a confidential clause in the arbitration agreement<\/span><\/li>\n<\/ul>\n<\/li>\n<li><b>Choice of Arbitrators:\u00a0<\/b>\n<ul>\n<li><span style=\"font-weight: 400;\">Parties can <\/span><b>specify any qualifications for arbitrators in their arbitration clause<\/b><span style=\"font-weight: 400;\">, such as experience in a certain area of the law, industry, subject area etc.<\/span><\/li>\n<\/ul>\n<\/li>\n<li><b>Finality:<\/b>\n<ul>\n<li><span style=\"font-weight: 400;\">An arbitration award mostly is final and<\/span><b> binding and there is generally no right of appeal.\u00a0\u00a0<\/b><\/li>\n<\/ul>\n<\/li>\n<li><b>Autonomy:<\/b>\n<ul>\n<li><span style=\"font-weight: 400;\">International arbitration is <\/span><b>less formal than judicial proceedings and allows the parties a degree of flexibility and autonomy t<\/b><span style=\"font-weight: 400;\">o agree on things like how the arbitration will be conducted, the procedural rules, and where the arbitration hearing will be held.\u00a0<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<li aria-level=\"1\"><b>Advantages over Litigation:\u00a0<\/b>\n<ul>\n<li><b>Speedy Resolution: <\/b><span style=\"font-weight: 400;\">The disputes are resolved more swiftly than traditional court litigation <\/span><b>since there are only limited appeals from arbitration awards.<\/b><\/li>\n<li><b>Quality Judgement:<\/b><span style=\"font-weight: 400;\"> International Arbitration <\/span><b>employees specialised arbitrators for having experience in the required<\/b><span style=\"font-weight: 400;\"> field thus a better chance in providing better-quality justice<\/span><\/li>\n<li><b>Participation by Parties:<\/b><span style=\"font-weight: 400;\"> Clients can play an active role in selecting an arbitrator who is an industry expert in International Arbitration, rather than a generalist like many domestic court judges.<\/span><\/li>\n<li><b>Flexibility:<\/b><span style=\"font-weight: 400;\"> International Arbitration is flexible as the individual parties to a dispute have a say in determining the rules and procedures of the agreement.<\/span><\/li>\n<li><b>Neutrality:<\/b><span style=\"font-weight: 400;\"> This is very important for cross-border transactions, since it a<\/span><b>voids the possibility of a \u201chome court\u201d advantage for one party.<\/b><\/li>\n<\/ul>\n<\/li>\n<li aria-level=\"1\"><b>Global Frameworks on Arbitration:<\/b>\n<ul>\n<li><b>UNCITRAL Model Law on International Commercial Arbitration:<\/b><span style=\"font-weight: 400;\"> This model law was adopted in <\/span><b>1985 to create uniformity in arbitration laws across participating nations.<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><b>International Chamber of Commerce (ICC): <\/b><span style=\"font-weight: 400;\">The ICC provides a system of rules for arbitration and conciliation, including arbitration rules for<\/span><b> international commercial disputes.\u00a0<\/b><\/li>\n<li style=\"font-weight: 400;\" style=\"font-weight: 400;\">uch as\u00a0<\/span>\n<ul>\n<li><b>The International Arbitration and Mediation Centre, Hyderabad (IAMC),\u00a0 Mumbai Centre for International Arbitration (MCIA),<\/b><span style=\"font-weight: 400;\"> the Delhi International Arbitration Centre (DIAC), and the very newly established India International Arbitration Centre (IIAC).\u00a0<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Legal Framework Governing Arbitration Law:<\/b>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><b>The Arbitration and Conciliation Act, 1996 (as amended in 2021):<\/b><span style=\"font-weight: 400;\"> The Act is closely modeled on the <\/span><b>1985 UNCITRAL Model Law<\/b><span style=\"font-weight: 400;\">.\u00a0<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"3\"><b>Part I: <\/b><span style=\"font-weight: 400;\">It governs arbitral proceedings seated in India\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"3\"><b>Part II: <\/b><span style=\"font-weight: 400;\">It governs the recognition and enforcement of foreign-seated arbitral awards.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><b>Provisions: <\/b><span style=\"font-weight: 400;\">The Act provides for the<\/span><b> appointment of arbitrators, the conduct of arbitral proceedings, recognition, and enforcement of arbitral awards<\/b><span style=\"font-weight: 400;\">, and sets out the grounds for challenging arbitral 400;\">The <\/span><b>government of the foreign country.<\/b><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Bar Council of India has notified the Bar Council of India Rules for Registration and Regulation of Foreign Lawyers or Foreign Law Firms in India, 2022.
