{"id":153397,"date":"2025-01-29T19:40:04","date_gmt":"2025-01-29T14:10:04","guid":{"rendered":"https:\/\/pwonlyias.com\/stage\/?post_type=current-affairs&#038;p=153397"},"modified":"2025-01-29T19:40:04","modified_gmt":"2025-01-29T14:10:04","slug":"split-verdicts-of-the-supreme-court","status":"publish","type":"current-affairs","link":"https:\/\/pwonlyias.com\/stage\/current-affairs\/split-verdicts-of-the-supreme-court","title":{"rendered":"Split Verdicts of the Supreme Court"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">The Supreme Court has recently delivered a split verdict in the<\/span><b> Chhattisgarh burial case.<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">In this case, <\/span><b>two judges of the SC disagreed<\/b><span style=\"font-weight: 400;\"> on whether a Christian man should be allowed to bury his father on private land or at a designated burial ground.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Justice<\/span><b> B V Nagarathna<\/b><span style=\"font-weight: 400;\"> held that the petitioner should be allowed to conduct funeral rights on his private agricultural land while<\/span><b> Justice S C Sharma <\/b><span style=\"font-weight: 400;\">ruled that the burial should take place at a designated Christian burial ground..\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">However,<\/span><b> unlike usual procedures, <\/b><span style=\"font-weight: 400;\">the <\/span><b>case was not referred to a larger Bench <\/b><span style=\"font-weight: 400;\">for a final decision.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: center;\"><span class=\"vc_button\"><a href=\"https:\/\/www.pw.live\/batches\/upsc\/pw-only-ias?utm_source=seo+upsc+batch&#038;utm_medium=seo+upsc&#038;utm_campaign=seo&#038;utm_id=upsc\" target=\"_blank\" rel=\"noopener\">Enroll now for UPSC Online Classes<\/a><\/span><\/p>\n<h2><span style=\"font-size: 18pt;\"><b>What is a Split Verdict?<\/b><\/span><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A split verdict occurs when a Bench with <\/span><b>an even number of judges cannot reach a unanimous<\/b><span style=\"font-weight: 400;\"> or <\/span><b>majority decision.\u00a0<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">This usually happens with <\/span><b>two-judge Benches (Division Benches)<\/b><span style=\"font-weight: 400;\">, where <\/span><b>both judges<\/b><span style=\"font-weight: 400;\"> have <\/span><b>differing opinions.<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Typically, <\/span><b>when a split verdict occurs, the case is referred to a larger Bench <\/b><span style=\"font-weight: 400;\">with an odd number of judges (three, five, or more) to ensure a final ruling.<\/span><\/li>\n<\/ul>\n<h2><span style=\"font-size: 18pt;\"><b>Past Instances of Split Verdicts and Their Outcomes<\/b><\/span><\/h2>\n<ul>\n<li aria-level=\"1\">\n<h3><span style=\"font-size: 16pt;\"><b>Karnataka Hijab Ban Case (2022)<\/b><\/span><\/h3>\n<ul>\n<li><span style=\"font-weight: 400;\">Justice Hemant Gupta upheld the hijab ban, stating that it applied equally to all students.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Justice Sudhanshu Dhulia struck down the ban, ruling that it violated students&#8217; right to education and freedom of religion.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">The case was referred to a larger Bench, but the SC has yet to begin hearings.<\/span><\/li>\n<\/ul>\n<\/li>\n<li aria-level=\"1\">\n<h3><span style=\"font-size: 16pt;\"><b>1993 Mumbai Blasts \u2013 Yakub Memon Death Sentence (2013)<\/b><\/span><\/h3>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Justice Anil R. color: #000000;\">It is a common format for hearing cases that require interpretation of laws or constitutional matters.<\/span><\/li>\n<\/ul>\n<h2><span style=\"font-size: 18pt; color: #000000;\"><b>Constitution Bench<\/b><\/span><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">A Constitution Bench is a <\/span><b>special bench of the Supreme Court of India c<\/b><span style=\"font-weight: 400;\">onsisting of<\/span><b> at least five judges.\u00a0<\/b><\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;
