color: #000000;\">State territories<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400; color: #000000;\">Union Territories<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400; color: #000000;\">Any acquired territories<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><span style=\"color: #000000;\"><b>Article 2: Admission or Establishment of New States<\/b><\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"color: #000000;\"><b>Parliament has the power to admit or establish new states.<\/b><\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"color: #000000;\"><b>The terms and conditions of such admission are decided by Parliament.<\/b><\/span><\/li>\n<\/ul>\n<p><span style=\"color: #000000;\"><b>Article 3: Formation and Alteration of States<\/b><\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"color: #000000;\"><b>Parliament can:<\/b><\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400; color: #000000;\">Form new states by separation, merging, or adding territories.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400; color: #000000;\">Alter state boundaries, names, and areas.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400; color: #000000;\">The President&#8217;s recommendation is required before introducing such a bill.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"color: #000000;\"><b>State legislature<\/b><span style=\"font-weight: 400;\"> views must be sought, but their <\/span><b>consent is not mandatory.<\/b><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><span style=\"color: #000000;\"><b>Article 4: Laws Related to Articles 2 and 3<\/b><\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">Laws unde<\/span><b>r Articles 2 and 3 can amend the First and Fourth Schedules.<\/b><\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">Such laws <\/span><b>do not count as a constitutional amendment <\/b><span style=\"font-weight: 400;\">under <\/span><b>Article 368.<\/b><\/span><\/li>\n<\/ul>\n<\/th>\n<\/tr>\n<\/tbody>\n<\/table>\n<p><\/div>\n<h2><span style=\"font-size: 18pt;\"><b>About Delhi Administration<\/b><\/span><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Delhi as a Union Territory<\/b><span style=\"font-weight: 400;\">: Delhi is classified as a Union Territory under the<\/span><b> First Schedule of the Constitution of India.<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Administration of Union Territories:<\/b><span style=\"font-weight: 400;\"> As per Article 239, a Union Territory is administered by the President through an Administrator appointed by the President.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Creation of Local Legislatures and Council of Ministers:<\/b><span style=\"font-weight: 400;\"> Article 239A allows for the creation of a local Legislature, a Council of Ministers, or both for certain Union Territories.<\/span><\/li>\n<\/ul>\n<h2><span style=\"font-size: 18pt;\"><b>Special Status of Delhi: 69th Amendment Act, 1991<\/b><\/span><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Article 239AA<\/b><span style=\"font-weight: 400;\"> was inserted into the Constitution through the 69th Amendment Act, 1991 to grant special status to Delhi.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">This amendment followed the recommendations of the<\/span><b> S. Balakrishnan Committee,<\/b><span style=\"font-weight: 400;\"> which <\/span><b>examined the demand for full statehood for Delhi.<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">After this amendment, Delhi is referred to as the <\/span><b>National Capital Territory (NCT) of Delhi.<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Designation of Administrator:<\/b><span style=\"font-weight: 400;\"> The Administrator of Delhi, appointed under<\/span><b> Article 239,<\/b><span style=\"font-weight: 400;\"> is designated as the <\/span><b>Lieutenant Governor (LG).<\/b><\/li>\n<\/ul>\n<h2><span style=\"font-size: 18pt;\"><b>Structure of Governance in Delhi<\/b><\/span><\/h2>\n<ul>\n<li><span style=\"font-weight: 400;\">The NCT of Delhi consists of:<\/span>\n<ul>\n<li><b>An Administrator (Lieutenant Governor)<\/b><\/li>\n<li><b>A Legislative Assembly<\/b><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h2><span style=\"font-size: 18pt;\"><b>Powers of the Delhi Legislative Assembly<\/b><\/span><\/h2>\n<ul>\n<li><b>Authority to Make Laws<\/b><span style=\"font-weight: 400;\">: As per Article<\/span><b> 239AA(3)<\/b><span style=\"font-weight: 400;\">, the Delhi Legislative Assembly has the power to legislate on subjects listed in the State List and Concurrent List, with certain exceptions.<\/span><\/li>\n<li><b>Exceptions or the Restricted Subjects: <\/b><span style=\"font-weight: 400;\">The Delhi Assembly cannot make laws on the following subjects from the State List:<\/span>\n<ul>\n<li><b>Public Order (Entry 1)<\/b><\/li>\n<li><b>Police (Entry 2)<\/b><\/li>\n<li><b>Land (Entry 18)<\/b><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h2><span style=\"font-size: 18pt;\"><b>Supremacy of Parliament<\/b><\/span><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Parliament retains the<\/span><b> power to legislate for Delhi on any subject, including those within the jurisdiction of the Delhi Assembly.<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">In case <\/span><b>\u00a0conflict <\/b><span style=\"font-weight: 400;\">between a Delhi law and a Parliamentary law, the <\/span><b>Parliamentary law prevails, and the Delhi law becomes void.<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Exception for Presidential Assent<\/b><span style=\"font-weight: 400;\">: If a Delhi law is reserved for Presidential assent and <\/span><b>approved by the President, it remains valid.<\/b>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">However,<\/span><b> Parliament can still amend, repeal, or override such a law at any time.<\/b><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<div class=\"vc_table_green\"><\/p>\n<table style=\"width: 99.7979%;\">\n<tbody>\n<tr>\n<th style=\"width: 100%; border-style: solid; border-color: #000000; background-color: rgba(184, 165, 217, 0.53); text-align: left; vertical-align: middle;\">\n<h3><span style=\"font-size: 16pt; color: #000000;\"><b>Provision for Strength of the Council of Ministers<\/b><\/span><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">As per the<\/span><b> 91st Constitutional Amendment Act<\/b><span style=\"font-weight: 400;\">, the<\/span><b> minimum strength of the Council of Ministers in a State is 12, <\/b><span style=\"font-weight: 400;\">while the <\/span><b>maximum strength is 15% <\/b><span style=\"font-weight: 400;\">of the total members of the Legislative Assembly.<\/span><\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #000000;\">Article 164 lays down other provisions regarding Ministers.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">Article 164(1A) specifies that the total number of Ministers, including the Chief Minister, <\/span><b>must not exceed 15% of the total strength <\/b><span style=\"font-weight: 400;\">of the <\/span><b>Legislative Assembly of the State.<\/b><\/span><\/li>\n<\/ul>\n<\/th>\n<\/tr>\n<\/tbody>\n<\/table>\n<p><\/div>\n<h2><span style=\"font-size: 18pt;\"><b>Council of Ministers\u00a0<\/b><\/span><\/h2>\n<ul>\n<li><b>Composition of Council of Ministers : Article 239AA(4) mandates the formation of a Council of Ministers, including the Chief Minister, <\/b><span style=\"font-weight: 400;\">with a strength <\/span><b>not exceeding 10% of the total number of Legislative Assembly members.<\/b><\/li>\n<li><b>Function of the Council of Ministers: <\/b><span style=\"font-weight: 400;\">The Council of Ministers <\/span><b>aids and advises the Lieutenant Governor <\/b><span style=\"font-weight: 400;\">on matters where the Delhi Assembly has legislative powers.<\/span><\/li>\n<\/ul>\n<h2><span style=\"font-size: 18pt;\"><b>Appointment and Tenure of the Chief Minister and Ministers<\/b><\/span><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Appointment Authority<\/b><span style=\"font-weight: 400;\">: The C<\/span><b>hief Minister of Delhi<\/b><span style=\"font-weight: 400;\"> is appointed by the <\/span><b>President of India<\/b><span style=\"font-weight: 400;\"> under<\/span><b> Article 239AA(5).<\/b>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">The other Ministers are appointed by the President<\/span><b> based on the advice of the Chief Minister.<\/b><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Tenure and Removal:<\/b><span style=\"font-weight: 400;\"> The Chief Minister and the Council of Ministers hold office at the pleasure of the President.<\/span><\/li>\n<\/ul>\n<h2><span style=\"font-size: 18pt;\"><b>Role of the Lieutenant Governor<\/b><\/span><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Discretionary Powers of the Lieutenant Governor: <\/b><span style=\"font-weight: 400;\">The Lieutenant Governor has the authority to act at his discretion in cases where law requires it.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Dispute Resolution Between the LG and Ministers:\u00a0 <\/b><span style=\"font-weight: 400;\">If there is a difference of opinion between the Lieutenant Governor and the Council of Ministers, the<\/span><b> LG can refer the matter to the President.<\/b>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Until the President takes a decision, the<\/span><b> LG can take immediate action if the matter is urgent.<\/b><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h2><span style=\"font-size: 18pt;\"><b>Limitations of the 69th Amendment Act<\/b><\/span><\/h2>\n<ul>\n<li><b>Ambiguous Division of Powers: <\/b><span style=\"font-weight: 400;\">The Act does not clearly define the powers of the Lieutenant Governor (LG) and the Council of Ministers, leading to frequent disputes and confusion in governance.<\/span><\/li>\n<li><b>Overlapping Jurisdiction: <\/b><span style=\"font-weight: 400;\">The LG can refer any disagreement with the Council of Ministers to the President, often causing delays and administrative conflicts.<\/span><\/li>\n<li><b>Unclear Role of the LG:<\/b><span style=\"font-weight: 400;\"> The Act does not explicitly define the LG\u2019s role in daily administration, leading to frequent disagreements with the Delhi Government.<\/span><\/li>\n<\/ul>\n<h2><span style=\"font-size: 18pt;\"><b>Supreme Court\u2019s Suggestions (2018 Judgment)<\/b><\/span><\/h2>\n<ul>\n<li><b>LG Must Act on Ministerial Advice: <\/b><span style=\"font-weight: 400;\">The LG is bound to act on the advice of the Council of Ministers except in matters where discretion is legally permitted.<\/span><\/li>\n<li><b>No Interference in Day-to-Day Administration:<\/b><span style=\"font-weight: 400;\"> The LG cannot interfere
