G. Gaikwad<\/b><span style=\"font-weight: 400;\"> was established. The commission recommended granting reservation to Marathas under the <\/span><b>Socially and Educationally Backward Class (SEBC)<\/b><span style=\"font-weight: 400;\"> category.<\/span><\/li>\n<\/ul>\n<table>\n<tbody>\n<tr>\n<td><b>About 102nd Constitution Amendment Act of 2018:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Articles 338B: <\/b><span style=\"font-weight: 400;\">It inserted Articles 338B, which deals with the structure, duties and powers of the <\/span><span style=\"font-weight: 400;\">National Commission for Backward Classes (NCBC) <\/span><span style=\"font-weight: 400;\">and,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Article 342A:<\/b><span style=\"font-weight: 400;\"> Which deals with power of the President to notify a particular caste as <\/span><span style=\"font-weight: 400;\">Socially and Educationally Backward Classes (SEBC) <\/span><span style=\"font-weight: 400;\">\u00a0and power of Parliament to change the list.<\/span><\/li>\n<\/ul>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p>\u00a0<\/p>\n<table>\n<tbody>\n<tr>\n<td><b>1992 Indira Sawhney Judgment: Key Precedents<\/b><\/p>\n<ul>\n<li><b>Criteria for Reservation:<\/b><span style=\"font-weight: 400;\"> &#8220;Social and Educational Backwardness&#8221;<\/span>\n<ul>\n<li><span style=\"font-weight: 400;\">The Indira Sawhney judgment established that for a group to be eligible for reservation, they must demonstrate &#8220;social and educational backwardness.&#8221;\u00a0<\/span><\/li>\n<\/ul>\n<\/li>\n<li aria-level=\"1\"><b>50% Limit on Vertical Quotas with &#8220;Exceptional Circumstances&#8221;<\/b>\n<ul>\n<li aria-level=\"1\"><span style=\"font-weight: 400;\">The ruling reiterated the 50% cap on vertical quotas to maintain administrative &#8220;efficiency.&#8221; However, it allowed for exceptions to this limit in &#8220;exceptional circumstances,&#8221;.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\"><\/li>\n<\/ul>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>November 2018:<\/b><span style=\"font-weight: 400;\"> Maharashtra government approves reservation for Marathas under the Socially and Educationally Backward Class Act, based on the Backward Class Commission&#8217;s findings led by <\/span><b>M G Gaikwad.June 2019: <\/b><span style=\"font-weight: 400;\">The Bombay High Court upholds the constitutional validity of the <\/span><b>Maratha quota under the Socially and Educationally Backward Classes (SEBC) Act, 2018. <\/b><span style=\"font-weight: 400;\">It reduces the quota from <\/span><b>16% to 12% in education and 13% in government jobs, <\/b><span style=\"font-weight: 400;\">following the recommendations of the Maharashtra State Backward Class Commission.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>May 2021:<\/b><span style=\"font-weight: 400;\"> A five-judge Constitution bench of the Supreme Court, strikes down the provisions of the Maharashtra law providing reservation to the Maratha community.\u00a0<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">The decision is made on the grounds that it exceeds the <\/span><b>50% quota limit set by the court in its 1992 Indra Sawhney (Mandal) judgment.<\/b><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>November 2022<\/b><span style=\"font-weight: 400;\">: After the Supreme Court upholds the 10% quota for the Economically Weaker Sections (EWS), the Maharashtra state government allows economically weaker members of the Maratha community to benefit from the EWS quota until the issue of Maratha reservation is resolved.<\/span><\/li>\n<\/ul>\n<p><b>Marathas Reservation Demand:<\/b><\/p>\n<table>\n<tbody>\n<tr>\n<td><b>The M.G Gaikwad Commission Found:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Socioeconomic Conditions:<\/b><span style=\"font-weight: 400;\"> Highlighted agricultural involvement, modest living conditions, and limited access to basic amenities.<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">It found that 76.86 % of Maratha families were engaged in agriculture and farm labour, around 50% lived in mud houses, only 35.39% had personal tap water connections<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Education and Literacy<\/b><span style=\"font-weight: 400;\">: Noted varying education levels, with a significant portion having low literacy.<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">13.42% of Marathas were not literate with only 35.31% having primary education.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Income and Poverty Levels<\/b><span style=\"font-weight: 400;\">: 93% Maratha families<\/span> <span style=\"font-weight: 400;\">had an annual income of \u20b91 lakh or less, and <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">37.38% families were Below Poverty Line.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Land Ownership:<\/b><span style=\"font-weight: 400;\"> Stressed that 71% owned less than 2.5 acres of land.<\/span><\/li>\n<\/ul>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Background:<\/b><span style=\"font-weight: 400;\"> The demand for Maratha reservation emerges from underdeveloped areas, particularly Marathwada and other regions in Maharashtra.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Core Agitating Districts:<\/b><span style=\"font-weight: 400;\"> Districts like Beed, Parbhani, Nanded, Aurangabad, and Jalna in Marathwada are pivotal in the agitation, later spreading across the state.<\/span><\/li>\n<\/ul>\n<p><b style=\"background-color: var(--global--color-background); color: var(--global--color-primary); font-family: var(--global--font-secondary); font-size: var(--global--font-size-base);\">Causes:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Economic Underdevelopment<\/b><span style=\"font-weight: 400;\">: Economic and industrial underdevelopment in these regions, exacerbated by consistent droughts, pose significant challenges to the local population.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Lack of Industrial Growth<\/b><span style=\"font-weight: 400;\">: Unlike western Maharashtra, Marathwada lacks substantial industrial growth, limiting employment opportunities beyond agriculture.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Agricultural Unsustainability:<\/b><span style=\"font-weight: 400;\"> Increasingly unsustainable agriculture forces rural youth into migration or aggressive political activism.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Government Job Aspirations<\/b><span style=\"font-weight: 400;\">: Scarce private sector jobs drive youth to seek government employment through competitive exams, leading to a pronounced demand for reservations in these sectors.<\/span><\/li>\n<\/ul>\n<p><b>Stand of Maharashtra Government:<\/b><\/p>\n<table>\n<tbody>\n<tr>\n<td><b>Who are Kunbis ?<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Kunbis<\/b><span style=\"font-weight: 400;\"> (the community associated with agriculture) are grouped under the <\/span><b>Other Backward Classes (OBC) <\/b><span style=\"font-weight: 400;\">category in <\/span><b>Maharashtra.<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">When Marathwada was part of the Hyderabad province, the community in the region was <\/span><b>counted as Kunbis (farmer community).\u00a0<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">After the Marathwada region became part of Maharashtra, the community got counted as Marathas.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>In 1967<\/b><span style=\"font-weight: 400;\">, Punjab Rao Deshmukh demanded<\/span><b> OBC status for Marathas of Vidarbha region<\/b><span style=\"font-weight: 400;\"> and in 2004, the Maharashtra government issued a Government Resolution (GR) giving Kunbi status to Marathas of that region.<\/span><\/li>\n<\/ul>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<ul>\n<li aria-level=\"1\"><b>Provision for Kunbi Caste Certificates: <\/b><span style=\"font-weight: 400;\">Maharashtra government approves the issuance of Kunbi caste certificates to Marathas from Marathwada possessing Nizam-era documents that acknowledge them as Kunbis.<\/span>\n<ul>\n<li aria-level=\"1\"><b>Objective:<\/b><span style=\"font-weight: 400;\"> Providing Marathas with Kunbi caste certificates implies categorizing them as Other Backward Classes (OBCs), allowing access to reservation benefits provided to OBCs.<\/span><\/li>\n<\/ul>\n<\/li>\n<li aria-level=\"1\"><b>Committee Formation for Standard Procedure:<\/b>\n<ul>\n<li aria-level=\"1\"><span style=\"font-weight: 400;\">The government has constituted a five-member committee led by <\/span><b>former Justice Sandeep Shinde <\/b><span style=\"font-weight: 400;\">to prepare the<\/span><b> Standard operating procedure (SOP) <\/b><span style=\"font-weight: 400;\">for issuing the Kunbi caste certificate.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"list-style-type: none;\"><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\"><\/li>\n<\/ul>\n<p><b>Reaction of OBC Organisations:<\/b><\/p>\n<ul>\n<li aria-level=\"1\"><b>Opposition to Maratha Demand: <\/b><span style=\"font-weight: 400;\">OBC organizations strongly oppose the Maratha demand for OBC reservation, viewing it as a potential threat to their own reserved quota.<\/span><\/li>\n<li aria-level=\"1\"><b>Reservation Concerns:<\/b><span style=\"font-weight: 400;\"> OBC leaders assert that it should not come at the expense of the existing OBC quota.
