Employment (MoL&#038;E) , Government of India and Labour Departments of the State Governments and Union Territories<\/b><span style=\"font-weight: 400;\"> are responsible for Occupational Safety and Health of workers.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/li>\n<\/ul>\n<h2><span style=\"font-size: 18pt;\"><b>What are the key findings of the ILO Report on Occupational Safety and Health?<\/b><\/span><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Work-Related Health Hazards:<\/b><span style=\"font-weight: 400;\"> Exposure to<\/span><b> long working hours ,<\/b><span style=\"font-weight: 400;\"> with almost 7.45 lakh people dying of it in 2016, followed by exposure to occupational<\/span><b> particulate matter, gases, and fumes (4.5 lakh deaths)<\/b><span style=\"font-weight: 400;\"> and occupational injuries (3.63 lakh deaths).<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Global Deaths: <\/b><span style=\"font-weight: 400;\">Nearly 30 lakh workers die every year globally due to work-related accidents and diseases.<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">More than 63% of these deaths are reported from the Asia-Pacific region.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Rising Diseases:<\/b><span style=\"font-weight: 400;\"> The rate of <\/span><b>non-melanoma skin cancer increased by over 37%<\/b><span style=\"font-weight: 400;\"> between 2000 and 2020.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Non-Compliance of ILO conventions: <\/b><span style=\"font-weight: 400;\">As per ILO report, <\/span><b>79 out of the 187 member<\/b><span style=\"font-weight: 400;\"> countries have ratified the <\/span><b>ILO Occupational Safety and Health Convention (No. 155)<\/b><span style=\"font-weight: 400;\">, while<\/span><b> 62 countries have ratified the Promotional Framework for Occupational Safety and Health Convention, 2006 (No. 187).\u00a0<\/b>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><b>India has not ratified both the conventions<\/b><span style=\"font-weight: 400;\">, however <\/span><span style=\"font-weight: 400;\">after the Uttarkashi tunnel incident, Central Trade Unions asked the Union government to sign these treaties.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<table style=\"width: 100.269%;\">\n<tbody>\n<tr>\n<th style=\"width: 100%; color: #000000;\">Minimum Age Convention (No.138)<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; color: #000000;\">Worst forms of Child Labour Convention (No.182)<\/span><\/li>\n<\/ul>\n<\/th>\n<\/tr>\n<\/tbody>\n<\/table>\n<h2><span style=\"font-size: 18pt;\"><b>What are the issues related to Occupational Safety in India?<\/b><\/span><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Predominance of the Unorganized and Informal Sectors: <\/b><span style=\"font-weight: 400;\">Around\u00a0 80% of India\u2019s workers are employed in the unorganized sector, and more than 90% in informal jobs.<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Such a huge part of the workforce is not covered by a majority of the labor laws which debar them from <\/span><span style=\"font-weight: 400;\">benefits like safety standards and minimum wage.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<table style=\"width: 100.299%;\">\n<tbody>\n<tr>\n<th style=\"width: 100%; border-style: solid; border-color: #000000; background-color: rgba(184, 165, 217, 0.53); text-align: left; vertical-align: middle;\"><span style=\"color: #000000;\"><b>Major occupational diseases\/morbidity of concern in India:<\/b><\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"color: #000000;\"><span style=\"font-weight: 400;\">Silicosis, musculoskeletal injuries, coal workers&#8217; pneumoconiosis,<\/span><b> chronic obstructive lung diseases, asbestosis, byssinosis, pesticide poisoning<\/b><span style=\"font-weight: 400;\"> and noise induced hearing loss<\/span><span style=\"font-weight: 400;\">.<\/span><\/span><\/li>\n<\/ul>\n<\/th>\n<\/tr>\n<\/tbody>\n<\/table>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li><b>India has not ratified<\/b><span style=\"font-weight: 400;\"> both the conventions.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Selective Occupational Safety and Health framework:<\/b><span style=\"font-weight: 400;\"> Apart from the existing <\/span><b>Occupational Safety and Health <\/b><span style=\"font-weight: 400;\">related legislations for the four sectors, i.e., the manufacturing, mining, ports and construction, legislation to cover the other sectors such as <\/span><b>agriculture sector, service sector, transport sector, etc., are not available leaving a huge gap.<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Lack of Defined Budget<\/b><span style=\"font-weight: 400;\">: The National Policy on Safety, Health and Environment at Workplace was announced in 2009. The review of policy is in progress. For effective implementation, there has been<\/span><b> no specific financial budget and scheme.<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Challenges in Managing Occupational Safety and Health Risks:<\/b><span style=\"font-weight: 400;\"> The changing job patterns and working relationships, outsourcing of work, homework and the increasing number of employees working away from their establishment, pose problems to management of occupational safety and health risks at workplaces.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Economic unpredictability:<\/b><span style=\"font-weight: 400;\"> India has seen two lockdowns and multiple restrictions. This creates economic uncertainty, making it difficult for organizations to make concrete decisions that transform the organization&#8217;s safety culture.<\/span><\/li>\n<\/ul>\n<p><b>Also Read: <\/b><a href=\"https:\/\/pwonlyias.com\/stage\/current-affairs\/informal-economy\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">India\u2019s Informal Economy: Over 90% Workforce, Half of GDP<\/span><\/a><\/p>\n<h2><span style=\"font-size: 18pt;\"><b>What laws and regulations are for Occupational Safety and Health in India?<\/b><\/span><\/h2>\n<ul>\n<li><b>Constitutional Framework: <\/b><span style=\"font-weight: 400;\">\u00a0Under the Constitution of India, labor is a subject in the concurrent list where both the Central and the State Governments are competent to enact legislation subject to certain matters reserved for the Central Government.<\/span>\n<ul>\n<li><b>Article 39:<\/b><span style=\"font-weight: 400;\"> It\u00a0 ensure that\u00a0 the citizens of India are provided with adequate means of livelihood, fair distribution of wealth, equal pay for equal work, protection of children and labor<\/span><\/li>\n<li><b>Article 42<\/b><span style=\"font-weight: 400;\">: Just and humane conditions of work and maternity relief are provided.<\/span><\/li>\n<\/ul>\n<\/li>\n<li><b>National Policy on Safety, Health and Environment at Workplace(2009):<\/b><span style=\"font-weight: 400;\">It recognizes a safe and healthy working environment as a fundamental human right.<\/span><\/li>\n<li><b>Legislative Framework: <\/b><span style=\"font-weight: 400;\">The Government of India has enacted four main legislations relating to Occupational Safety and Health (OSH) at workplaces:<\/span>\n<ul>\n<li><b>The Factories Act, 1948 ,<\/b><span style=\"font-weight: 400;\"> covering factories wherein the enforcement of safety at workplace is by the Chief Inspector of Factories in the respective states<\/span><\/li>\n<li><b>The Mines Act, 1952<\/b> <b>and Mines Rules, 1955 <\/b><span style=\"font-weight: 400;\">for mining industry where the enforcement is by the Directorate General of Mines Safety (DGMS) under Ministry of Labour &#038; Employment , Government of India<\/span><\/li>\n<li><b>The Dock Workers (Safety, Health and Welfare) Act<\/b><span style=\"font-weight: 400;\">, 1986 followed by notification of the <\/span><b>Dock Workers (Safety, Health and Welfare) Regulations, 1990<\/b><span style=\"font-weight: 400;\"> dealing with the major ports of India<\/span><\/li>\n<li><b>The Building &#038; Other Construction Workers (Regulations of Employment and Conditions of Service) Act, 1996<\/b><span style=\"font-weight: 400;\"> , covering construction workers at construction sites wherein the enforcement is by the Directorate General Labour Welfare in the central sphere and by the Labour Commissioners\/Factory Inspectorates in the States\/UTs<\/span><\/li>\n<\/ul>\n<\/li>\n<li><b>Mechanisms to Prevent Industrial Disaster, Protect Environment and Promote Public Safety:<\/b>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><b>National Disaster Management Authority (NDMA):<\/b><span style=\"font-weight: 400;\"> Its primary purpose is to coordinate response to natural or man-made disasters and for capacity-building in disaster resiliency and crisis response.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>OSH Code (Occupational Safety, Health and Working Conditions Code) &#8211; 2020:<\/b><span style=\"font-weight: 400;\">\u00a0<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">National database to be created for the InterState Migrant Workers.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Instead of 240 days, now if a worker has worked 180 days, he shall be entitled for one-day leave for every 20 days of work done.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h2><span style=\"font-size: 18pt;\"><b>Way Forward:<\/b><\/span><\/h2>\n<ul>\n<li><b>Implementation of recommendation of ILO Report on Occupational Safety and Health:<\/b>\n<ul>\n<li><span style=\"font-weight: 400;\">The report\u00a0 <\/span><b>recommended five categories of \u201cFundamental Principles and Rights at Work\u201d<\/b><span style=\"font-weight: 400;\"> for ensuring safety and health at work. These are:<\/span>\n<ul>\n<li><span style=\"font-weight: 400;\">freedom of association;<\/span><\/li>\n<li><span style=\"font-weight: 400;\">effective recognition of the right to collective bargaining,<\/span><\/li>\n<li><span style=\"font-weight: 400;\">elimination of all forms of forced or compulsory labour, abolition of child labour,\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\">elimination of discrimination in respect of employment and occupation, and<\/span><\/li>\n<li><span style=\"font-weight: 400;\">a safe and healthy working environment.<\/span><\/li>\n<\/ul>\n<\/li>\n<li><b>Role of\u00a0 Social Dialogue and Participation: <\/b><span style=\"font-weight: 400;\">In line with the core principles of the ILO Conventions, a sound and resilient <\/span><b>national occupational safety and health (OSH) framework, <\/b><span style=\"font-weight: 400;\">built on social dialogue and participation, is essential for the realization of the fundamental right to a safe and healthy working environment.<\/span><\/li>\n<\/ul>\n<\/li>\n<li><b>Upskilling employees in workplace ergonomics<\/b><span style=\"font-weight: 400;\">: According to the American authority on <\/span><span style=\"font-weight: 400;\">Occupational Safety and Health<\/span><span style=\"font-weight: 400;\">, 34% of workplace injuries are ergonomics-related, costing organizations nearly USD 50 billion per year.<\/span>\n<ul>\n<li><span style=\"font-weight: 400;\">Upskilling employees in workplace ergonomics will support a safer environment.\u00a0<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Integrating Ministries and Allocating Resources for Occupational Safety and Health Awareness and Prevention:<\/b><span style=\"font-weight: 400;\"> At the national level, the government needs to include all relevant ministries to ensure that workers&#8217; safety and health are prioritized in the national agenda.\u00a0<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">This requires <\/span><b>allocating adequate resources to increase general awareness<\/b><span style=\"font-weight: 400;\"> around Occupational Safety and Health, knowledge of hazards and risks, and an understanding of their control and prevention measures.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Establishing a Specialized Research Institution for Workplace Safety, Health, and Environment: <\/b><span style=\"font-weight: 400;\">An institution in the country needs to be identified for providing research in the field of safety, health and environment at workplace and by developing innovative methods for dealing with safety, health and environment at workplace.<\/span><\/li>\n<\/ul>\n<table style=\"width: 100.501%;\">\n<tbody>\n<tr>\n<th style=\"width: 100%;
