{"id":58313,"date":"2023-11-29T19:50:49","date_gmt":"2023-11-29T14:20:49","guid":{"rendered":"https:\/\/pwonlyias.com\/stage\/?post_type=current-affairs&#038;p=58313"},"modified":"2023-11-29T19:50:49","modified_gmt":"2023-11-29T14:20:49","slug":"privileges-committee-of-rajya-sabha","status":"publish","type":"current-affairs","link":"https:\/\/pwonlyias.com\/stage\/current-affairs\/privileges-committee-of-rajya-sabha","title":{"rendered":"Privileges Committee Of Rajya Sabha"},"content":{"rendered":"<p><b>Context: <\/b><span style=\"font-weight: 400;\">The Privileges Committee of Rajya Sabha was convened recently to discuss unresolved complaints against Opposition MPs.<\/span><\/p>\n<h2><span style=\"font-size: 18pt;\"><b>More about the news:\u00a0<\/b><\/span><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The committee has decided to summon them for an in-person defense presentation.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The charges against the MPs include:\u00a0\u00a0<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">breach of privilege\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Making allegations against high authorities.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h2><span style=\"font-size: 18pt;\"><b>About Committee of Privileges:<\/b><\/span><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Mandate: <\/b><span style=\"font-weight: 400;\">\u00a0The mandate of the committee is to examine such cases and \u201cmake such recommendations as it may deem fit\u201d.<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">It can call the relevant people and\u00a0 related documents as part of its examination.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">It Submit a report and if the Council has not fixed any time for its presentation, the report shall be presented within <\/span><b>one month of the date<\/b><span style=\"font-weight: 400;\"> on which reference was made to the Committee .<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">A motion has to be passed for the consideration of the report and amendments can be suggested.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">The Chairman or any member of the Committee or any other member can move that the Council agrees, disagrees, or agrees with amendments, with the recommendations contained in the report.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Lok Sabha:<\/b><span style=\"font-weight: 400;\"> It\u00a0 consists of <\/span><b>15 Members<\/b><span style=\"font-weight: 400;\"> nominated by the Speaker.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Rajya Sabha:<\/b><span style=\"font-weight: 400;\"> It consists of <\/span><b>10 members<\/b><span style=\"font-weight: 400;\"> and is nominated by the Chairman of Rajya Sabha. In the Rajya Sabha, the deputy chairperson heads the committee of privilege.<\/span><\/li>\n<\/ul>\n<h2><span style=\"font-size: 18pt;\"><b>What is a Privilege Motion and who can move it?<\/b><\/span><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Rights and immunities: <\/b><span style=\"font-weight: 400;\">All Members of Parliament (MPs) and State Assembly (MLAs) enjoy rights and immunities, individually and collectively, so that they can discharge their duties and functions effectively.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Breach of privilege:<\/b><span style=\"font-weight: 400;\"> Any instance when these rights and immunities are disregarded by any member of Lok Sabha or Rajya Sabha leads to the breach of privilege which is punishable under the Laws of Parliament.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Privilege Motion: <\/b><span style=\"font-weight: 400;\">Any member from either house can move a notice in the form of a motion against the member who he\/she thinks is guilty of the breach of privilege.<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Both Houses of the Parliament reserve the right to punish any action of contempt (not necessarily breach of privilege) which is against its authority and dignity, as per the laws.\u00a0<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The right to raise a question of privilege is based on satisfying two conditions, namely:\u00a0<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">The question shall be restricted to a specific matter of recent occurrence, and\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">The matter requires the intervention of the Council.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Significant Cases: <\/b><span style=\"font-weight: 400;\">\u00a0In 1978, <\/span><b>Indira Gandhi<\/b><span style=\"font-weight: 400;\"> was expelled from the Loksabha for <\/span><b>breach of privilege<\/b><span style=\"font-weight: 400;\"> against her following observations made by the Justice Shah Commission, which probed excesses during the Emergency.<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">in 1976 the Rajya Sabha expelled <\/span><b>\u00a0Subramanian Swamy<\/b><span style=\"font-weight: 400;\"> over charges of bringing disrepute to Parliament through his activities through interviews in foreign publications that were construed as \u201c<\/span><b>anti-India propaganda<\/b><span style=\"font-weight: 400;\">\u201d.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><b>News Source:<\/b> <a href=\"https:\/\/www.thehindu.com\/news\/national\/rajya-sabha-privileges-committee-to-call-opposition-mps-against-whom-there-are-complaints\/article67583508.ece\" target=\"_blank\" rel=\"nofollow noopener\"><span style=\"font-weight: 400;\">The Hindu<\/span><\/a><\/p>\n<p>\u00a0<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Context: The Privileges Committee of Rajya Sabha was convened recently to discuss unresolved complaints against Opposition MPs.
