{"id":91567,"date":"2024-02-29T20:08:56","date_gmt":"2024-02-29T14:38:56","guid":{"rendered":"https:\/\/pwonlyias.com\/stage\/?post_type=current-affairs&#038;p=91567"},"modified":"2025-03-03T12:10:39","modified_gmt":"2025-03-03T06:40:39","slug":"article-371a","status":"publish","type":"current-affairs","link":"https:\/\/pwonlyias.com\/stage\/current-affairs\/article-371a","title":{"rendered":"Article 371A and Coal Mining Regulations in Nagaland"},"content":{"rendered":"<h2><span style=\"font-size: 18pt;\"><b>Context:\u00a0\u00a0<\/b><\/span><\/h2>\n<p><b>Article 371A <\/b><span style=\"font-weight: 400;\">of the <\/span><a href=\"https:\/\/pwonlyias.com\/stage\/upsc-notes\/constitution-of-india-journey\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Constitution of India<\/span><\/a><span style=\"font-weight: 400;\"> has been the <\/span><b>major hurdle <\/b><span style=\"font-weight: 400;\">in the <\/span><a href=\"https:\/\/pwonlyias.com\/stage\/current-affairs\/nagaland-statehood-day\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Nagaland<\/span><\/a><span style=\"font-weight: 400;\"> government\u2019s <\/span><b>efforts to regulate small-scale <\/b><a href=\"https:\/\/pwonlyias.com\/stage\/current-affairs\/illegal-sand-mining\/\" target=\"_blank\" rel=\"noopener\"><b>illegal coal mining<\/b><\/a><span style=\"font-weight: 400;\"> activities in the State.<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Article 371A <\/b><span style=\"font-weight: 400;\">had impeded ensuring the scientific mining of coal across five districts in the State.<\/span><\/li>\n<\/ul>\n<h2><span style=\"font-size: 18pt;\"><b>About Article 371A<\/b><\/span><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">No Act of <\/span><a href=\"https:\/\/pwonlyias.com\/stage\/upsc-notes\/parliament\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Parliament<\/span><\/a><span style=\"font-weight: 400;\"> in respect of religious or social practices of the Nagas, <\/span><b>Naga customary law and procedure, administration of <\/b><a href=\"https:\/\/pwonlyias.com\/stage\/criminal-law-reforms-in-india\/\" target=\"_blank\" rel=\"noopener\"><b>civil and criminal justice<\/b><\/a><b> involving decisions according to Naga customary law, <\/b><span style=\"font-weight: 400;\">and ownership and transfer of land and its resources, <\/span><b>shall apply to Nagaland unless the state Assembly decides by a resolution to do so.<\/b><\/li>\n<\/ul>\n<h3><span style=\"font-size: 14pt;\"><b>Main Provisions of Article 371A<\/b><\/span><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Role of Governor:<\/b><span style=\"font-weight: 400;\"> The <\/span><a href=\"https:\/\/pwonlyias.com\/stage\/current-affairs\/states-in-supreme-court\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Governor<\/span><\/a><span style=\"font-weight: 400;\"> shall have special responsibility concerning law and order in the state for as long as internal disturbances continue therein o<\/span><b>r in any part thereof, and he shall exercise his judgment in this matter after consulting the <\/b><a href=\"https:\/\/pwonlyias.com\/stage\/upsc-notes\/union-council-of-ministers\/\" target=\"_blank\" rel=\"noopener\"><b>Council of Ministers<\/b><\/a><b>.<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Regional Council: <\/b><span style=\"font-weight: 400;\">There shall be established a regional council for the<\/span><b> Tuensang district, consisting of 35 members <\/b><span style=\"font-weight: 400;\">and the Governor shall make rules for its composition and functioning.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Power of Regional Council:<\/b><span style=\"font-weight: 400;\"> The <\/span><a href=\"https:\/\/pwonlyias.com\/stage\/current-affairs\/autonomous-district-councils\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">regional council<\/span><\/a> <span style=\"font-weight: 400;\">shall have powers concerning making laws on certain matters such as land, forests, fisheries,<\/span><b> village administration, inheritance of property, marriage and divorce, social customs <\/b><span style=\"font-weight: 400;\">etc., within the Tuensang district.<\/span><\/li>\n<\/ul>\n<table style=\"width: 100.1%;\">\n<tbody>\n<tr>\n<th style=\"width: 100%; color: #000000;\">Once the pits are dug, miners descend to the coal seams using ropes or bamboo ladders.
