Issues such as the <\/span><b>composition of legislatures<\/b><span style=\"font-weight: 400;\">, the<\/span><b> role of nominated members<\/b><span style=\"font-weight: 400;\">, and the <\/span><b>power of administrators<\/b><span style=\"font-weight: 400;\"> create complexities. These challenges impact democratic representation and federal cooperation, especially in places like Puducherry and Delhi.<\/span><\/p>\n<h2><span style=\"font-size: 18pt;\"><b>Issues Related to Union Territories<\/b><\/span><\/h2>\n<p><b>Challenges in the Governance of Union Territories: <\/b><span style=\"font-weight: 400;\">The governance structure of Union Territories (UTs) in India presents several <\/span><b>constitutional and legal challenges<\/b><span style=\"font-weight: 400;\"> that highlight their inherent fragility within the Indian Federation:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Legislature Composition:<\/b><span style=\"font-weight: 400;\"> The<\/span><b> 14th<\/b><a href=\"https:\/\/pwonlyias.com\/stage\/udaan\/constitutional-amendment\/\"><b> Constitutional Amendment Act<\/b><\/a><b> of 1962 <\/b><span style=\"font-weight: 400;\">included <\/span><b>Article 239A, <\/b><span style=\"font-weight: 400;\">which gives<\/span><b> Parliament the authority to create legislatures for UTs.<\/b><span style=\"font-weight: 400;\">\u00a0<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">But this has led to a situation where a simple amendment to <\/span><b>The Government of Union Territories Act, 1963<\/b><span style=\"font-weight: 400;\"> can create a legislature that is largely made up of members who have been nominated\u2014more than half of the total.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Issue of Nomination:<\/b><span style=\"font-weight: 400;\"> According to the<\/span><b> Government of Union Territories Act, Puducherry <\/b><span style=\"font-weight: 400;\">will have a<\/span><b> 33-member House, <\/b><span style=\"font-weight: 400;\">of which the<\/span><b> Central government <\/b><span style=\"font-weight: 400;\">will nominate<\/span><b> three members.\u00a0<\/b>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><b>Legal Challenge: <\/b><span style=\"font-weight: 400;\">A legal challenge arose<\/span> <span style=\"font-weight: 400;\">when the Union authority nominated representatives to the Assembly<\/span><b> without first contacting the local authority<\/b><span style=\"font-weight: 400;\">.<\/span><b>\u00a0<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><b>K. Lakshminarayanan v. Union of India: <\/b><span style=\"font-weight: 400;\">The Supreme Court of India decided in 2019<\/span><b> that <\/b><span style=\"font-weight: 400;\">nominated members had the<\/span><b> same voting rights<\/b><span style=\"font-weight: 400;\"> as elected members and that the State government&#8217;s consultation was not necessary for nominations<\/span><b>.<\/b><span style=\"font-weight: 400;\">\u00a0<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"3\"><span style=\"font-weight: 400;\">This problem draws attention to a possible<\/span><b> lack of accountability and openness<\/b><span style=\"font-weight: 400;\"> in the nomination process<\/span><b>.<\/b><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Arbitrariness in Nomination:<\/b><span style=\"font-weight: 400;\"> Article 239A and the Government of Union Territories Act do not specify any criteria for the Puducherry Assembly<\/span><b>, in contrast to the Rajya Sabha, <\/b><span style=\"font-weight: 400;\">where such requirements are mandated.<\/span><b>\u00a0<\/b>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><b>The democratic ideals of representation and knowledge <\/b><span style=\"font-weight: 400;\">may be compromised by this omission, which encourages arbitrary selection of UT <\/span><a href=\"https:\/\/pwonlyias.com\/stage\/udaan\/membership-in-state-legislatures\/\"><span style=\"font-weight: 400;\">legislative members<\/span><\/a><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Administrator&#8217;s Power<\/b><span style=\"font-weight: 400;\">: Union Territories lack the independence and democratic system required for self-governance. <\/span><b>Significant power is vested in the administrator (Lieutenant Governor), who frequently clashes with the legislators of UTs that are elected to government<\/b><span style=\"font-weight: 400;\">.\u00a0<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">The administrator may disagree and send issues to the President, who makes decisions in accordance with the advice of the Union government.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">This structure essentially gives the Union government the authority to decide on contentious matters.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Federal cooperation has been impacted by such tensions, which have been noted in areas such as Puducherry and the National Capital Territory of Delhi.<\/span><\/li>\n<\/ul>\n<\/li>\n<li><b>Overlapping Jurisdictions: <\/b><span style=\"font-weight: 400;\">A Legislative Assembly for Puducherry is established by the <\/span><b>Government of Union Territories Act, 1963<\/b><span style=\"font-weight: 400;\">, along with a <\/span><b>Council of Ministers<\/b><span style=\"font-weight: 400;\">.\u00a0<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">The <\/span><b>council&#8217;s recommendations do not, however, bind the administrator<\/b><span style=\"font-weight: 400;\">.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Conflicts and overlapping responsibilities arise between the Union government and the Union Territory&#8217;s elected government as a result.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p style=\"text-align: center;\"><i><span class=\"vc_button\"><\/i><a href=\"https:\/\/www.pw.live\/batches\/upsc?utm_source=seo+upsc+batch&#038;utm_medium=seo+upsc&#038;utm_campaign=seo&#038;utm_id=upsc\" target=\"_blank\" rel=\"noopener\"><i>Enroll now for UPSC Online Course<\/i><\/a><i><\/span><\/i><\/p>\n<table>\n<tbody>\n<tr>\n<td style=\"border-style: solid; border-color: #000000; background-color: #e9ebe8;\"><b>Ignite your Mind:<\/b><\/p>\n<p><span style=\"font-weight: 400;\">We often hear the advantages of having smaller states; administrative convenience being the prominent one. government was provided by the Delhi Administration Act, of 1966.\u00a0 <\/span><b>69th Amendment <\/b><span style=\"font-weight: 400;\">added <\/span><b>Article 239AA <\/b><span style=\"font-weight: 400;\">&#038; <\/span><b>Article 239AB<\/b><span style=\"font-weight: 400;\"> which gave <\/span><b>constitutional status<\/b><span style=\"font-weight: 400;\"> and the National Capital Territory of Delhi (GNCT) Act, 1991 was enacted based on recommendations of the <\/span><b>Balakrishnan Committee Report<\/b><span style=\"font-weight: 400;\">.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Election Commission under<\/span><b> Article 324<\/b><span style=\"font-weight: 400;\"> conducts elections to the Legislative Assembly of
