They placed the Constitution above ordinary law and expected that future generations will respect this document.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">At the same time, they recognised that, in the future, this document may require modifications.<\/span><\/li>\n<li aria-level=\"1\">The framers of the Indian Constitution wanted it to be both <span style=\"font-weight: 400;\">\u2018<strong>flexible<\/strong>\u2019 and at the same time \u2018<strong>rigid<\/strong>\u2019<\/span>.\n<ul style=\"text-align: justify;\">\n<li aria-level=\"1\">They designed it so that some parts could be easily changed, making it flexible.<\/li>\n<li aria-level=\"1\">However, certain core features <span style=\"font-weight: 400;\"><strong>central to the spirit of the Constitution <\/strong><\/span>were made difficult to change, ensuring they remained rigid.<\/li>\n<li aria-level=\"1\">This way, the Indian Constitution balances both flexibility and rigidity<\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">The Indian Constitution combines both of these characteristics.<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">However, the <strong>procedure laid down<\/strong> for its amendment is <strong>neither as easy as in Britain nor as difficult as in the USA<\/strong>.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><strong>Article 368 of PART XX:<\/strong> provides power and procedure to Parliament for constitutional amendments.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><strong>Supreme Court in the Kesavananda Bharati case<\/strong> (1973) evolved the basic structure doctrine and further consolidated the balance between rigidity and flexibility.\u00a0<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">It says\u00a0 that <strong>certain parts cannot be amended<\/strong>, it has underlined the rigid nature while by allowing amendments to all others it has underlined the flexible nature of the amending process.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h3 style=\"text-align: justify;\"><span style=\"color: #ff6600; font-size: 18pt;\"><strong>How Does India Execute Constitutional Amendments?<\/strong><\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Article 368 provides the procedure for the amendment of the constitution as below:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It says, \u201cNotwithstanding anything in this Constitution, Parliament may, in exercise of its constituent power, amend by way of addition, variation or repeal any provision of this Constitution in accordance with the procedure laid down in this article\u201d.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><strong>Introduction of Bill:<\/strong> A bill for constitutional amendment can be introduced in any house of the Parliament.<\/span>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">That bill can be introduced as a government bill or a private member bill.\u00a0<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><strong>No Prior Approval:<\/strong> Bill does not require prior permission of the president.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><strong style=\"font-family: var(--list--font-family); background-color: var(--global--color-background); color: var(--global--color-primary); font-size: var(--global--font-size-base);\">Passing the Bill: <\/strong>The bill must be approved in each House by a special majority, meaning it needs more than 50 percent of the total members and a two-thirds majority of the members present and voting.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><strong style=\"font-family: var(--list--font-family); background-color: var(--global--color-background); color: var(--global--color-primary); font-size: var(--global--font-size-base);\">No Joint Sitting: If there is a disagreement between the two Houses, there is no provision for a joint sitting to resolve it<\/strong><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><strong style=\"font-family: var(--list--font-family); background-color: var(--global--color-background); color: var(--global--color-primary); font-size: var(--global--font-size-base);\">Amendment of Federal Provisions:<\/strong><span style=\"font-family: var(--list--font-family); background-color: var(--global--color-background); color: var(--global--color-primary); font-size: var(--global--font-size-base);\"> If the bill seeks to amend the federal provisions of the Constitution,<\/span>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It must be ratified by a special majority and<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">It must also be approved by a simple majority in the legislatures of half of the states.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><strong>Obligatory Presidential Assent:<\/strong>\u00a0After being duly passed by both the Houses of Parliament and ratified by the state legislatures, where necessary, the bill is presented to the president for assent.<\/span>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-family: var(--list--font-family); background-color: var(--global--color-background); color: var(--global--color-primary); font-size: var(--global--font-size-base);\">The <strong>President cannot send the bill back<\/strong> for reconsideration and must give their assent to it.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">The <strong>24th constitutional amendment act 1971<\/strong> made it obligatory for the president to give his assent to the constitutional amendment bill.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">After the president\u2019s assent, the bill becomes a <strong>constitutional amendment act<\/strong>, and the Constitution shall stand amended in accordance with the terms of the bill.<\/span><\/li>\n<\/ul>\n<table style=\"border-collapse: collapse; font-size: 18pt;\">What Paths Does India Follow for Constitutional Amendments?<\/span><\/strong><\/h3>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><strong>Article 368<\/strong> of the Constitution provides two methods of amending the Constitution and they apply to two different sets of articles of the Constitution.<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\"><strong>Special Majority Amendment:<\/strong> Some provisions of the constitution can be amended by special majority.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\"><strong>Special Majority and State Ratification:<\/strong> While federal provisions of the constitution can be amended by special majority plus ratification by the half states.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><strong>Simple Majority Amendments Beyond Article 368:<\/strong> Whereas several provisions of the constitution can be amended\u00a0 by simple majority in Parliament which is similar to ordinary law\u00a0 as mentioned in some articles ( Article 2 and Article 3).\u00a0<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">However, <strong>these are not considered to be amendments to the constitution as per article 368<\/strong>.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Thus, the Constitutional amendment can be amended in three ways: <strong>Simple majority, Special majority, <\/strong>and<strong> Special majority<\/strong> plus ratification of the half states.<\/span><\/li>\n<\/ul>\n<h3 style=\"text-align: justify;\"><span style=\"color: #ff6600; font-size: 18pt;\"><strong>Understanding Constitutional Amendments in India through Simple Majority<\/strong><\/span><\/h3>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">There are many articles in the Constitution which mention that these articles can be amended by a simple law of the Parliament.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">No special procedure for Constitutional amendment is required in such cases and there is no difference at all between an amendment and an ordinary law.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">These constitutional amendments fall <strong>outside the scope of Article 368<\/strong>.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">These sections of the Constitution are very flexible.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><strong>These provisions include,<\/strong>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Admission or establishment of new states.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Abolition or creation of legislative council in state.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Quorum in parliament.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Salaries and allowances of the members of parliament.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Privileges of the parliament.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Use of official language and Use of English language in Parliament.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Number of puisne judges in the Supreme Court.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Citizenship\u2014acquisition and termination.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Elections to Parliament and state legislatures and Delimitation of constituencies.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Union territories, Fifth Schedule and Sixth Schedule.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h3 style=\"text-align: justify;\"><span style=\"color: #ff6600; font-size: 18pt;\"><strong>Understanding Constitutional Amendments in India through Special Majority<\/strong><\/span><\/h3>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><strong>Understanding the Special Majority:<\/strong> The majority of the provisions in the Constitution need to be amended by a special majority of Parliament. Special majority requires,<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-family: var(--list--font-family); background-color: var(--global--color-background); color: var(--global--color-primary);
