style=\"font-weight: 400;\"> Punishment <\/span><b>imposed to avenge the crime committed.<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Deterrence: <\/b><span style=\"font-weight: 400;\">It aims to<\/span><b> prevent future crimes by imposing punishment<\/b><span style=\"font-weight: 400;\"> that<\/span><b> dissuades both t<\/b><span style=\"font-weight: 400;\">he <\/span><b>perpetrator and the general public <\/b><span style=\"font-weight: 400;\">from <\/span><b>engaging in similar behavior.<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Reformation or Rehabilitation:<\/b><span style=\"font-weight: 400;\"> It focuses on <\/span><b>reforming the behavior <\/b><span style=\"font-weight: 400;\">of the<\/span><b> perpetrator to prevent future offenses.<\/b><\/li>\n<\/ul>\n<h2><span style=\"font-size: 18pt;\"><strong>Issues in Prevention of Cruelty to Animals Act 1960<\/strong><\/span><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Bail and Non-Cognisable Offenses: <\/b><span style=\"font-weight: 400;\">Many offenses under the<\/span><b> PCA Act <\/b><span style=\"font-weight: 400;\">are<\/span><b> bailable and non-cognisable,<\/b><span style=\"font-weight: 400;\"> allowing accused<\/span><b> individuals to seek bail easily and preventing immediate<\/b> <b>police action without court permission. <\/b><span style=\"font-weight: 400;\">This delays<\/span><b> justice and hampers effective enforcement.<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Inadequate Fines: <\/b><span style=\"font-weight: 400;\">The fines <\/span><b>prescribed under the PCA Act <\/b><span style=\"font-weight: 400;\">have remained unchanged since 1890, rendering them <\/span><b>insignificant and failing <\/b><span style=\"font-weight: 400;\">to act as a <\/span><b>deterrent against animal cruelty.<\/b><span style=\"font-weight: 400;\"> In many cases, <\/span><b>fines are as low as \u20b910<\/b><span style=\"font-weight: 400;\">, which does <\/span><b>not reflect the seriousness <\/b><span style=\"font-weight: 400;\">of the offenses.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Discretionary Sentencing: <\/b><span style=\"font-weight: 400;\">The law grants courts <\/span><b>discretion to choose between imposing imprisonment or a fine on offenders, <\/b><span style=\"font-weight: 400;\">even for <\/span><b>severe cases of animal cruelty.\u00a0<\/b>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">This <\/span><b>leniency allows perpetrators t<\/b><span style=\"font-weight: 400;\">o evade <\/span><b>appropriate punishment, <\/b><span style=\"font-weight: 400;\">undermining the <\/span><b>deterrent effect of<\/b><span style=\"font-weight: 400;\"> the law.<\/span><\/li>\n<\/ul>\n<\/li>\n<li><b>Lack of Rehabilitation Measures:<\/b><span style=\"font-weight: 400;\"> The <\/span><b>PCA Act lacks provisions<\/b><span style=\"font-weight: 400;\"> for <\/span><b>alternative forms <\/b><span style=\"font-weight: 400;\">of <\/span><b>punishment such as community service<\/b><span style=\"font-weight: 400;\">, which could help<\/span><b> reform perpetrators<\/b><span style=\"font-weight: 400;\"> and address the root causes of <\/span><b>animal cruelty.<\/b><\/li>\n<\/ul>\n<h2><span style=\"font-size: 18pt;\"><strong>Steps taken by Government<\/strong><\/span><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Draft Prevention of Cruelty to Animal (Amendment) Bill 2022:<\/b><span style=\"font-weight: 400;\"> In <\/span><b>November 2022, the Draft PCA (Amendment) Bill,<\/b><span style=\"font-weight: 400;\"> 2022 was published by the <\/span><b>Department of Animal Husbandry and Dairying f<\/b><span style=\"font-weight: 400;\">or public comments.
