USTR Section 301 Investigation: Why India Is Under US Trade Probe

The Office of the United States Trade Representative (USTR) has launched a Section 301 investigation into 16 countries, including India and China.

  • This is the first major trade probe by the administration of Donald Trump after the Supreme Court of the US ruled tariffs imposed under the International Emergency Economic Powers Act (IEEPA) illegal.

What is Section 301 Investigation?

  • Section 301 is a provision under the Trade Act of 1974 that allows the Office of the USTR to investigate unfair trade practices by other countries.
  • It is used when foreign policies or practices violate trade agreements or discriminate against US commerce.
  • Objective: To protect US industries, workers, and intellectual property rights from unfair foreign competition.
  • Penalty: If unfair practices are confirmed, the US government can impose retaliatory measures, such as tariffs, import restrictions, or other trade sanctions.

Why is India Being Investigated under Section 301?

  • Trade Surplus: India had a bilateral trade surplus of about $58 billion with the United States in 2025, which has raised concerns in the investigation.
  • Excess Manufacturing Capacity: The Office of the USTR alleges that India has excess production capacity in several manufacturing sectors, leading to overproduction.
  • Export Sectors Under Scrutiny: India’s global trade surplus sectors include textiles, healthcare products, construction goods, and automotive products.
  • Solar Module Overcapacity: The US claims that India’s solar module manufacturing capacity is nearly three times its domestic demand, indicating structural overcapacity.

About the International Emergency Economic Powers Act (IEEPA)

  • The IEEPA was enacted in 1977 in the United States to give the President powers to regulate economic transactions during national emergencies involving foreign threats
  • Presidential Authority: It allows the US President to impose economic sanctions, trade restrictions, or asset freezes against foreign countries, entities, or individuals.
  • Use in Foreign Policy:  The law is widely used to enforce sanctions related to national security, terrorism, nuclear proliferation, and international conflicts.
