Recently, Pavel Durov, the founder of Telegram, was arrested in Paris on charges related to child sexual abuse material, drug trafficking, and non-cooperation with law enforcement. 

  • This case raises important questions about the liability of digital platform owners for the content their users generate.

Concerns Surrounding The Arrest Of Telegram Founder

  • Privacy and Free Speech in the Digital Age: Governments around the world have increasingly been cracking down on tech companies and their executives, particularly those that prioritise user privacy and refuse to comply with government demands for data access. 
    • This trend has raised concerns about the future of privacy and free speech in the digital age.
    • For instance, in a similar case, Julian Assange, the founder of WikiLeaks, was arrested and faced extradition to the United States on charges related to the publication of classified information.

User Generated Content:  

  • User Generated Content: User-generated content (UGC) refers to any form of content, such as text, videos, images, or reviews, that is created and uploaded by users of a platform or service rather than by the platform’s official staff or content creators. 
    • Examples include social media posts, comments, forum discussions, and uploaded media on platforms like Facebook, Instagram, and YouTube
  • Controversies over Encryption: 
    • Use in Propaganda: Both sides in the Russia and Ukraine conflict have accused each other of using Telegram and similar apps for propaganda.
    • Illicit Activities: Encrypted platforms are also criticised for their role in coordinating illicit activities amid the ongoing conflict.

Issues with End-to-End Encryption Apps or Services

  • Restricted Access to Encrypted Messages: Platforms with end-to-end encryption cannot view or act on reported messages due to their secure nature.
    • End-to-end encryption (E2EE) is a method of secure communication that prevents third-parties from accessing data while it’s transferred from one end system to another. 
  • Minimal Metadata Recording: Platforms that record little to no metadata face challenges in cooperating with law enforcement regarding user data. Minimal metadata storage can restrict understanding of user interactions and patterns.
    • Metadata is data about data. It is information about data that provides context or details beyond its primary content. It includes attributes such as how the data was collected, where it is stored, and how it is used.
  • Confidentiality of Private Communications: Apps like Telegram ensures the privacy of one-on-one and group chats, limiting enforcement actions on these messages.
    • However, despite its encryption policies, Telegram allows scrutiny of content on public channels.
  • Potential for Abuse: Encrypted platforms might be used for illicit activities, complicating legal oversight.
  • Challenges in Content Moderation: Harder for platforms to monitor or manage user-generated content effectively.

Safe Harbour Principle

  • About: The safe harbour principle is a legal doctrine that protects online platforms and intermediaries from being held liable for user-generated content.
  • Core Aspect of Safe Harbour Principle: 
    • Protection from Liability: Platforms are typically protected from liability for user-generated content under the safe harbour principle. 
    • Neutral Intermediary Role: This principle asserts that platforms should not be held responsible for the content posted by their users as long as they act as neutral intermediaries and do not actively participate in or control the creation of that content.

Impact on Safe Harbour Protection in India For Apps Like Telegram

  • Legal enforcement:  Platforms that do not comply with IT Rules in India may face legal enforcement.
  • Investigation into Illegal Activities: The Ministry of Electronics and Information Technology is investigating Telegram for alleged involvement in illegal activities like extortion and gambling.
  • Consensus on Regulatory Enforcement: However, there is broad consensus among stakeholders in India that personal liability for regulatory violations should not be imposed. 
    • Instead, it may be more effective to impose higher penalties for repeated offences or consider banning persistently non-compliant entities.

Possible Consequences If Founders Face Personal Liability 

  • Increasing Adoption of End-to-End Encryption: If platform founders face personal liability for user-generated content, more messaging platforms might adopt end-to-end encryption and reduce metadata storage to avoid helping law enforcement.
  • Encryption as a Marketing Tool: Platforms are using encryption as a marketing tool to attract users and ensure privacy.
  • Negotiating with Governments:  Major platforms may quickly negotiate with governments to establish rules that prevent misuse of their power.
  • Broader Concerns: The debate has expanded from free speech to include issues of sovereignty and how platforms are regulated.

  • Privacy Protection: Privacy must also be preserved, meaning platforms should avoid excessive monitoring or interception of user communications. 
    • For instance, when there was dissemination of misinformation on WhatsApp during elections in India, the platform limited the ability to simultaneously forward messages to multiple groups and reduced group sizes. 
  • Compliance and Cooperation: Additionally, platforms should have compliance officers or designated representatives to cooperate with law enforcement, provided that due process is followed. 
    • Ensuring such measures and establishing clear procedural protocols should be a key focus for messaging platforms.
  • Stricter Content Moderation and Regulatory Trends: There is a growing shift towards stricter content regulation. Example: Passing of the Digital Services Act (DSA).

European Union’s Digital Services Act (DSA) 

  • Passed by: It was passed by the European Parliament in July 2022. 
  • About: It is a comprehensive set of rules designed to enhance online safety and transparency for European Union (EU) users. 
  • Key provisions of the DSA:
    • Content Regulation: DSA mandates online platforms to actively prevent and remove illegal or harmful content, including hate speech, terrorism, and child abuse. 
    • Targeted Advertising Restrictions: Online platforms are prohibited from using a person’s characteristics like sexual orientation, religion, ethnicity, or political beliefs for targeted advertising. 
    • Safeguarding Children: They are safeguarded from excessive or inappropriate ads through ad targeting restrictions.
    • Algorithm Transparency: Platforms must disclose how their algorithms function and impact the content they display.
    • Stricter Rules for Large Platforms: Large online platforms, reaching over 10% of the EU population must share data with researchers and authorities, cooperate in crisis responses, and undergo external audits.
