GI Tags in India: A Geographical Indication (GI) is a special tag given to products that are unique to a specific location, region, or country due to their quality, reputation, or traditional methods. It helps protect the authenticity of these products and boosts their market value, like Darjeeling Tea or Banarasi Sarees. 

About Geographical Indication Tag (GI Tag): Celebrating Origin, Quality, and Cultural Heritage

  • A Geographical indication Tag (GI Tag) is a sign used on products that have a specific geographical origin and possess qualities or a reputation that are due to that origin. 
  • Geographical Indications are covered as a component of Intellectual Property Rights (IPRs) under the Paris Convention for the Protection of Industrial Property.
    • Geographical indications are typically used for agricultural products, foodstuffs, wine and spirit drinks, handicrafts, and industrial products.
  • First product in India to be accorded with GI tag was Darjeeling tea in the year 2004-05.

Process Governing GI Tag: From International Standards to Local Recognition

  • International Level: At the International level, GI Tag is governed by the World Trade Organisation’s (WTO’s) Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS). 
  • National Level: In India, Geographical Indications registration is administered by the Geographical Indications of Goods (Registration and Protection) Act, 1999 which allowed India to join the WTO and sign the convention. 
  • GI registry: It has been set up under the Controller General of Patents, Designs, and Trade Marks to administer the GI of Goods (Registration and Protection) Act, 1999, which protects the GI of goods.
  • Validity: This tag is valid for a period of 10 years following which it can be renewed.
  • Beneficiary of GI Tag: A GI registration is given to an area, not a trader, but once a product gets the registration, traders dealing in the product can apply to sell it with the GI logo.

Methods to Protect a Geographical Indication: Exploring Sui Generis Systems and Trademarks for IP Protection

  • Sui generis systems (i.e. special regimes of protection): A “sui generis” system means “one that is of its own kind”. 
    • It refers to the creation of a new national law or the establishment of international norms that would afford protection to intellectual property dealing with genetic resources.
  • Using collective or certification marks such as Trademarks.

These newly registered products include unique handicrafts, traditional foods, and indigenous agricultural items. The addition of these GI-tagged products enhances their market value, protects their authenticity, and promotes sustainable livelihoods for local artisans and farmers.

Kapdaganda shawl
  • It is an embroidered shawl on an off-white coarse cloth with red, yellow and green colored threads by women of the Dongria Kondh tribe
Lanjia Saura Painting
  • It is a painting art that belongs to the Lanjia Saura community, paintings are in the form of exterior murals
Koraput Kala Jeera Rice
  • It is a black-colored rice variety, famous for its aroma, taste, texture and nutritional value. 
Similipal Kai chutney
  • It is a chutney made with red weaver ants by the tribals in Odisha’s Mayurbhanj district. Chutney is a good source of protein, calcium, zinc etc.
Nayagarh Kanteimundi Brinjal
  • They are known for the prickly thorns on the stems and whole plant. The green and round fruits contain more seeds as compared to other genotypes.
Odisha Khajuri Guda
  • It is a natural sweetener extracted from date palm trees and has its origin in the Gajapati district.
Dhenkanal Magji
  • It is a sweet made from buffalo milk cheese, with a distinct appearance, taste, flavor, shape, and size.
