Q.1 आप बुलन्दशहर के एसएसपी के रूप में कार्यरत हैं और यह एक ताकतवर राजनेता का निर्वाचन क्षेत्र है। हाल ही में एक अल्पसंख्यक व्यक्ति जो एक सोशल एक्टिविस्ट भी था , को पेड़ से बांध दिया गया और धार्मिक नारे लगाने के लिए उसे मजबूर किया गया । सत्तारूढ़ दल के कुछ राजनीतिक कार्यकर्ताओं ने उसे बुरी तरह से मारा और इस घटना का वीडियो सोशल मीडिया पर वायरल हो गया। मामला दर्ज करने और प्रारंभिक जांच के बाद आपको पता चलता है कि अल्पसंख्यक व्यक्ति को मारने वाले लोग उसे मंत्री के कट्टर अनुयायी थे। मंत्री बार-बार आपको फोन करते हैं और आप पर दबाव डालते हैं कि या तो जांच धीमी गति से करें या सबूतों की कमी का हवाला देकर मामले की जांच बंद कर दें। अपनी जांच में आपको उस अल्पसंख्यक व्यक्ति को न्याय दिलाने और मंत्री के अनुयायियों को दंडित करने के लिए पुख्ता सबूत मिले हैं। हालांकि, मंत्री ने धमकी दी है यदि आप उसके अनुरोधों पर ध्यान नहीं देते हैं तो आपका स्थानांतरण किसी दूर स्थान पर कर दिया जाएगा। दबाव के बावजूद आप अपनी जांच जारी रखते हैं और अपराधियों के खिलाफ एक मजबूत मामला दर्ज करते हैं। बाद में आपको पता चलता है कि मंत्री ने अपने प्रभाव का इस्तेमाल किया था और अपने अनुयायियों को जमानत दिलाने के लिए न्यायाधीशों को रिश्वत दी थी। निम्नलिखित प्रश्नों का औचित्य सिद्ध कीजिए: a) अपना कर्तव्य निभाते समय आप राजनीतिक दबाव से कैसे निपटेंगे? b) उपरोक्त मामले में आपकी पत्नी आपको मंत्री के साथ हुई बातचीत को रिकॉर्ड करने और मीडिया के माध्यम से कॉल रिकॉर्डिंग को सार्वजनिक करने की सलाह देती है। क्या आप ऐसा करेंगे? c) आपके कुछ मित्र आपको स्थानांतरण करवाकर नई जगह पर चले जाने का सुझाव देते हैं ताकि आप उसे मंत्री के क्रोध से बच जाएं जिसके अनुरोधों की आपने उपेक्षा की। इसमें आपकी क्या राय है? Q.10 Case study 1: Suman is a senior Indian Foreign Service (IFS) officer working under the Ministry of External Affairs in Delhi. The ministry has organized an BRICS summit which is an annual event for every year. Like every year, this year also, many foreign delegates from different BRICS Country have confirmed their participation in the event. The event is important for India’s economic growth and diplomacy in many contexts. But two countries are at war and one of them is a member of BRICS initiative. The International Criminal Court (ICC) issued a warrant for the president of that country to arrest him, stating that there’s reason to believe that he “bears responsibility for the war crime of unlawful deportation of population and that of unlawful transfer of population from occupied areas of the victim country to his country, in prejudice of the victim country’s children.” However, the International Criminal Court (ICC) has requested India to arrest and give them one of the BRICS participants as he is prosecuted by ICC for war crimes and genocide in his country. India is not a signatory to ICC and as such is not bounded by the decisions of ICC. However, India has always criticized such crimes and has always been a good, moral state. Suman has been asked to prepare the answer to be given to ICC in regard to their request. Q1- Analyse the situation and explain, with reasons, what answer Suman should give to ICC in this regards? You are working as SSP of Bulandshahr and it is the place of a constituency of powerful politician who is now a very influential minister in the state government. Recently a Minority person who is a social activist was tied to tree and was forced to chant religious slogan. He was badly beaten by few political activists belonging to the ruling party. The video of incident has gone viral on Social Media. After registering the case and preliminary investigation you come to know that the men who beaten the Minority person were staunch followers of the minister. The minister frequently calls you and pressurises you to either go slow with investigation or close the case citing lack of evidence. In your investigation you have found strong evidence to give justice to the Minority person and punish minister’s followers. However, the minister has threatened to transfer you to a distant place if you do not heed to his requests. Despite throats and pressures you continue with your investigation and file a strong case against the perpetrators. Later you come to know that the minister had used his influence and bribed the judges to get bail to his followers. a) How do you deal with political pressure when performing your duty? b) In the above case. your wife advises you to record your conversations with the minister in your cell phone and make them public via media.
