This essay argues that AI ethics is not a niche technical concern but a societal imperative, an intersectional project grounded in constitutional morality, democratic regulation, public accountability, and inclusive innovation. Drawing on Indian and global examples, it shows that the ethics of AI is ultimately about who controls it, who is protected by it, and who is harmed when it fails.

AI systems gain their “intelligence” from vast datasets shaped by human societies and their inherent inequalities. Historical data reflecting biases in areas like hiring, policing, housing, and healthcare can cause AI to inherit and even amplify discrimination if not carefully filtered. Additionally, the model’s objective function shapes outcomes such as recommendation algorithms prioritizing user engagement that may promote divisive content. Without explicit fairness criteria, systems tend to optimize results that reinforce social inequalities. Thus, an AI model’s architecture is not merely technical but also a moral framework that can either embrace ethical diversity or prioritize narrow efficiency.

India has made strides through the Digital Personal Data Protection Act, but the absence of AI-specific laws and audit mechanisms remains a critical gap. In a society as diverse and hierarchical as India’s, failure to regulate AI could deepen existing social fissures.

Socio-Economic Impacts and Discrimination

AI has far-reaching social and economic implications. In welfare delivery, Aadhaar’s integration with public distribution systems has led to numerous exclusion errors. Fingerprint mismatches due to manual labor or technical glitches have denied food and pensions to the most vulnerable. Healthcare too, despite its promise, is riddled with ethical uncertainty. AI sorting systems used during COVID-19 to prioritize ICU beds raised questions of whose lives were being valued more. When AI decides treatment paths or insurance eligibility, it must be built on principles of equity, transparency, and medical ethics, not just data efficiency.

Private Sector Ethics and Market Incentives

The private sector plays a dominant role in AI development, but is often driven by market imperatives rather than ethical mandates. Corporate secrecy around proprietary models, the so-called “black boxes” makes it difficult for regulators, civil society, or even users to understand how decisions are made. This undermines the principle of accountability. Moreover, downstream harms such as job losses, misinformation, or discriminatory outcomes are rarely traced back to the companies that designed the systems.

There is a growing need to institutionalize vendor accountability. Governments and large public institutions can use public procurement as leverage  by mandating that AI tools meet ethical benchmarks and undergo third-party audits before adoption. Ethical innovation must be incentivized, not left to the goodwill of tech giants.

India’s Path to Ethical AI

Creating an ethical AI ecosystem in India requires an integrated approach across regulation, infrastructure, capacity, and culture. A purely technocratic or top-down model will not work in a society as diverse and unequal as India’s.

First, India must move from voluntary codes to a statutory AI regulation framework, rooted in constitutional values of equality, dignity, and non-discrimination. High-risk use cases such as welfare eligibility, policing, hiring, and healthcare must be subject to mandatory algorithmic impact assessments, with public summaries, open consultations, and parliamentary oversight.

Second, government procurement processes must mandate transparency-by-design. Systems built for public service should be open to audit, backed by grievance mechanisms, and designed for inclusion. India’s success with UPI and CoWIN was not just about technology but about governance. Future platforms must learn from both their successes and their exclusions.

Third, public investment in representative, de-biased Indian datasets is crucial. Most global models are trained on Western, English-dominant data. This makes them ill-suited for India’s linguistic, cultural, and socioeconomic diversity. Initiatives like Bhashini are a step in the right direction, but must be paired with privacy safeguards and participatory dataset governance.

Fourth, India needs a dedicated AI Safety and Ethics Authority, independent of both the government and corporate interests, but empowered to coordinate with regulators, set standards, and issue recalls for harmful systems. This institution should work alongside the Competition Commission, Consumer Protection Authority, and Data Protection Board.

Fifth, access to compute infrastructure, safety toolkits, and open benchmarks must be democratised. Otherwise, AI safety will remain a privilege of a few Big Tech labs, while Indian startups and academia remain consumers of black-box technologies.

Sixth, AI literacy must be mainstreamed not just for developers, but for civil servants, lawyers, judges, journalists, and ordinary citizens. Ethical rights mean little if people cannot understand or assert them. Civic education, regulatory transparency, and media literacy must go hand-in-hand.

Finally, civil society and journalism must play a central role. Investigative reports have unearthed algorithmic harms in welfare, finance, and law enforcement globally. Similar watchdog efforts in India are essential for a culture of accountability.

Global Diplomacy and India’s Ethical Leadership

India stands at a unique juncture as a digital leader among developing nations and as a pluralistic democracy grappling with internal inequities. It can become a voice for ethical norm-setting in the Global South by advocating for frameworks that prioritize equity, openness, and decentralization. In forums like the G20, GPAI (Global Partnership on AI), and UN advisory bodies, India must push for global AI governance that is not dictated solely by the US-China binary.

India’s lived experience with multilingualism, caste inequities, and federal governance makes it well-placed to offer models for equity-first AI that other plural democracies can emulate. This leadership must be grounded not in technological supremacy, but in moral clarity.

Philosophical and Political Core of AI Ethics

At its heart, AI is not just a tool it is a mirror to our values and power structures. Every line of code encodes assumptions about what matters, who matters, and what trade-offs are acceptable. In India, where democracy and diversity are foundational, technology must be evaluated not just by what it does, but by whom it serves.

Gandhi’s philosophy offers powerful guidance here. For him, the means were as important as the ends, a principle deeply relevant to AI ethics. If an AI system achieves efficiency by erasing nuance, silencing dissent, or marginalizing the weak, then the harm outweighs the benefit. Likewise, India’s constitutional morality emphasizing liberty, equality, and dignity must anchor every AI decision. As Dr. B.R. Ambedkar reminded us, “Constitutional morality is not a natural sentiment. It has to be cultivated.”
