India-Australia Relations: Present Status

  •  Recent years have certainly seen the end of political neglect. Sustained high-level exchanges have provided much-needed political momentum to the India-Australia partnership.
  • After much hesitation, Delhi is now reciprocating. In 2022, 10 union ministers from India traveled to Australia.

Shared Interests:

  • Although India-Australia shared democratic traditions, the English language, extended neighborhood, and massive economic synergies, it was hard to bring them close together.
  • The complementarity between a rapidly growing Indian economy and the energy and mineral-rich Australia was always there to see. 
    • But it is only in the past couple of years that this complementarity has been turned into a concrete Economic Cooperation and Trade Agreement (ECTA).

Harnessing Complementaries:

  • Strengthing India’s supply chains: As Delhi turns to clean energy in a big way and ramps up its production of electronic goods, Australia’s role as a major supplier of critical minerals has come into view. 
    • The ECTA will strengthen India’s supply chains for the critical minerals essential to produce mobile phones, flat screen monitors, wind turbines, solar panels and electric cars in India.
  • Cooperation in education: Australia also has a strong fit with the Indian effort to modernize its higher education sector under the New Education Policy.
    • Nearly 60,000 Indians are studying in Australia at the end of 2022.
  • China’s Challenge: The rapid rise and assertiveness of China provided a powerful new context for the transformation of Asia’s international relations, including bilateral ties between Delhi and Canberra. 
    • Given the vast size of the Indo-Pacific theatre, Delhi and Canberra also need to enhance their political coordination and strategic collaboration in the various subregions — including the southern ocean, Arabian Sea, Bay of Bengal, eastern Indian Ocean, and the South Pacific.

Challenges:

  • Mutual political neglect, ignorance of commercial possibilities, and Cold War geopolitics limited the possibilities for bilateral relations during the 20th century. 
  • Delhi and Canberra must recognise the continuing anxiety in the region about the potential problems the Quad could trigger, especially with China. 

Conclusion:

  • The rapid growth in the strategic salience of the India-Australia relationship underlines the importance of continuous re-evaluation of relationships and the questioning of the political assumptions about other countries that acquire a life of their own and prevent productive diplomacy.

Context:

The arrest of the former Delhi Deputy Chief Minister, Manish Sisodia, by the Central Bureau of Investigation (CBI) recently has once again created a debate about the fundamentals of law enforcement. 

The two sides:

  • Arrests involve a grave human rights issue.
  • An arrest was the only deterrent to dishonesty in public life.
  • Taking advantage of lacuna, many accused persons, when arrested, knock on the doors of the judiciary immediately after their arrest, seeking court intervention and clemency.
  • A few judges at the lower echelons are taken in by the emotion-laden arguments of the defence lawyer and grant bail to the accused even when produced for the first time after an arrest.

Procedure of arrest:

  • The Code of Criminal Procedure 1973 lays down the procedure to effect an arrest. 
  • Section 41 debunks the commonly held belief that a police officer must necessarily obtain a warrant from a magistrate before making an arrest. 
  • Arrests can be made without a warrant provided the officer making it is convinced that there was no time to obtain one and records the reasons in the general diary of the police station or the police branch concerned for not obtaining a warrant prior to the arrest.
  • The main stipulation of the law and judicially accepted norms are that the officer should not use any force to effect an arrest unless the accused  himself chooses to be violent. 
  • There is also the constitutional provision (Article  22) that a detained person should be apprised of the grounds of arrest as soon as possible and be produced before the nearest magistrate within 24 hours  (excluding travel time) of taking him into custody. 
  • It is also incumbent on the official concerned to keep the closest relative of the accused informed  that the person is in custody at a specified place.

What is not included in the Criminal Procedure Code?

  • Beyond these safeguards there is nothing in the Criminal Procedure Code that reduces the discretion of the police or law enforcement officials in making an arrest decision. 
  • The investigator enjoys absolute freedom in opting for an arrest. 
  • In the oft-quoted D.K. Basu vs State of West Bengal also, while the top court laid down the detailed  procedures for an arrest, it did not in any way dilute the discretion of a law enforcement agency in making arrests.

Looking within: 

  • When the law is silent in the matter it is the basic responsibility of senior law enforcement officers, at the Centre and in the States to ensure sobriety and objectivity. 

Conclusion:

  • It is also preposterous to believe that an agency such as the CBI will be totally free of bias or selectivity. 
  • However, no premier investigating agency would dare resort to peremptory action such as an arrest of a prominent public figure without preparing the ground in the form of the evidence available in documents and oral statements.

Context: 

The Centre has released the endorsement  guidelines for celebrities and social media influencers titled as the “Endorsements Know-hows!”. 

  • These guidelines have been issued under the overall ambit of Consumer Protection Act 2019. 

What are Celebrity Endorsement:

  • Endorsements are a form of advertising that uses famous personality or celebrities or social  media influencers who command high degree of recognition, trust, respect or awareness among the people. 
  • Endorsement by celebrities or influencers have a greater capability to persuade buyers as they are viewed as role models in a society. 

Ethical Issues in Influencer Endorsement:

  • Instances of misuse of Trust: Followers are bound in a strong manner with the influencer. They trust that influencers would not recommend something that is harmful, or low quality. However, this is not the case with brand marketing by such influencers. 
  • High influence but less responsibility: Influencers have higher ability to persuade consumers. However, there is no responsibility mechanism for checking the endorsed products. 
  • Difficult to distinguish commercial messaging: Promotion by influencers often do not look like commercials but rather as general advices. o Advertisements are posted without any such disclosure and are difficult to identify. 
  • Lack of understanding of nature or quality of product by influencers: Sometimes, influencers themselves have limited idea of the quality of product they are promoting. This was evident in Fyre festival fraud. 
  • Conflict of interest and deceptive marketing: Often the products are advertised showing that they have been made keeping the benefits of consumer in mind but are actually promoted based solely on profit motive. 
  • Targeting of vulnerable groups such as children or teenagers, that may not be able to critically evaluate the products that influencers are promoting.

Perspective of Influencer: 

  • Unreasonable expectation of detailed due diligence: Celebrities are often blamed for not performing due diligence on brands they endorse. This expectation of due diligence is often open-ended and unreasonable. 
    • Also, appropriate data for such due diligence may not be in public domain. 
  • Brand responsibility: Influencer groups have argued that Brands should be made equally responsible for framing a misleading advertisement in the first place. 
  • Moral boundaries, in the case of products like carbonated beverages and fairness creams, should be drawn by the individual celebrity himself/herself. 
    • For instance, P. Gopichand decided not to endorse carbonated soft drinks owing to their deleterious health effects. 
  • Influencers reputation and credibility is at stake in a brand’s endorsement. So, they themselves are often mindful about endorsement decisions as their name is associated with the brand image for a long time. 

Guidelines for Celebrity and Social Media Influencers:

  • Compulsory disclosure of monitory or material benefits of a product or a brand they are promoting through their social media platforms. 
  • Penalty: Failure of compulsory disclosure will attract a penalty up to ₹ 50 lakh.
  • Clear communication: The disclosures must be prominently and clearly displayed in the endorsement and terms such as ‘advertisement’, ‘sponsored’ or ‘paid promotion’ should be used for all sort of endorsements. 
  • Advertise responsibly: They should not endorse any product or service in which due diligence has not been done by them or that they have not personally used or experienced.

Way Forward 

  • Code of ethics for social media influencers: It should include establishment of authenticity of the products by them and promoting safe and beneficial products to their audience. 
  • Self-regulation by celebrity or influencer groups: Influencer marketing industry should come up with a set of guidelines and best practices that influencers can follow to ensure that their promotions are ethical and transparent. 
  • Effective age restrictions and parental controls: To prevent targeting of children or teenagers to such misleading advertisements. 
  • Creation of a governmental due diligence structure: Government can form a committee or a forum to consistently check products or services for their claims. 
    • This will limit the onus of due diligence on celebrities and will create a sense of brand responsibility.
