International Transgender Day of Visibility, observed on March 31, draws attention to the struggles and resilience of the transgender community.

Challenges Associated with Transgenders in India

  • Transgender Persons (Protection of Rights) Act, 2019: Despite the enactment of the Transgender Persons (Protection of Rights) Act, 2019, transgender persons in India continue to face deep-rooted discrimination, economic marginalisation, and limited access to essential services.
  • Implementation Gaps the Act: The Act provides legal recognition and safeguards, but suffers from poor on-ground execution
    • By December 2023, only 15,800 out of 24,115 identity card applications were approved; over 3,200 were pending beyond the 30-day mandate. 
    • In Delhi, just 23 identity cards were issued, despite a transgender population of over 4,200 (Census 2011).
  • Bureaucratic Barriers: The certification process is cumbersome and contradicts the global principle of self-identification. The law fails to address police harassment, family rejection, and social exclusion, diluting its impact.
  • Economic Exclusion: As per a 2018 NHRC report, 92% of transgender individuals are excluded from the workforce, forcing many into sex work
    • A 2022 study recorded a transgender unemployment rate of 48%, drastically higher than the national average of 7–8%.
  • Workplace Discrimination: Discrimination begins at recruitment, continues with hostile environments, and includes:
    • Lack of gender-neutral restrooms
    • Exclusion by colleagues
    • Limited support from HR and management
  • Limited Industry Response: While companies like Tata Steel have recruited over 100 transgender employees, such efforts are rare across industries.
  • Educational Disparities: Education plays a critical role in the empowerment of transgender individuals, but systemic discrimination creates stark disparities.
    • As per the 2011 Census, the transgender literacy rate stood at only 56.1%, compared to the national average of 74.04%.
  • Barriers in Educational Spaces: A 2016 Kerala study found that 58% of transgender students dropped out due to bullying, harassment, and unsupportive environments.
    Educational institutions often lack gender-neutral infrastructure, inclusive policies, and emotional support systems.
  • Barriers to Healthcare Access: Transgender persons face discrimination, financial exclusion, and inadequate infrastructure in healthcare.
    • Despite provisions under the National Health Policy (2017) and Ayushman Bharat, access remains poor.
    • A National Legal Services Authority survey revealed that 27% were denied medical care due to their gender identity.
  • Coverage Challenges: Gender-affirming treatments cost between ₹2 lakh to ₹5 lakh, making them inaccessible to most. The ‘Ayushman Bharat TG Plus’ card provides ₹5 lakh annual coverage, but implementation is patchy.
  • Lack of Trained Professionals: Doctors and medical staff lack training in transgender-specific needs. Mental health support for transgender persons remains severely underprovided, contributing to higher rates of depression and anxiety.
  • Gaps in Opportunities: Transgender persons continue to face workplace bias, identity documentation hurdles, healthcare discrimination, and limited access to credit and jobs, which collectively hinder their social and economic inclusion.

Way Forward

  • Policy Progress: In 2024, the Finance Ministry allowed LGBTQ+ individuals to open joint bank accounts and nominate partners as beneficiaries
  • Policy Measures Needed: Mandatory training for healthcare workers on transgender health.
    • Insurance inclusion for gender-affirming treatments Establishment of dedicated transgender health clinics and expansion of mental health services tailored to the needs of the community.
  •  State-Led Initiatives: Some states have taken progressive steps, Maharashtra has set up transgender cells in colleges.
    The University of Kerala provides reserved seats and hostel facilities for transgender students.
  • Diverse Media Representation: The media must portray transgender individuals in varied roles—as professionals, leaders, and artists—not just as victims or comic relief. Positive representation can shift narratives and promote mainstream acceptance.
  • Removing  Biases in Institutions: Discrimination in families, schools, and workplaces continues to marginalize transgender persons. Gender-insensitive environments contribute to exclusion in education, employment, and social spaces.
  • Cultural Advocacy: Initiatives like the ‘I Am Also Human’ campaign by The Humsafar Trust play a key role in changing perceptions. Cultural events such as Tamil Nadu’s Koovagam Festival promote visibility and acceptance through traditional and religious platforms.
  • Anti-Discrimination laws: Enforcing anti-discrimination laws, promoting inclusive hiring, and offering support for transgender entrepreneurs are critical to economic integration. Government and corporate bodies must move beyond symbolic gestures to ensure equal opportunities and protections.

Transforming societal perceptions requires more than visibility—it demands genuine inclusion, legal protection, and institutional reform. True equality will be achieved only through collective action that upholds the dignity, rights, and integration of transgender individuals in every sphere of public and private life.
