Should the CJI be part of the committee selecting the CEC?

Context:

The Union government recently introduced a Bill in the Rajya Sabha. 

  • This Bill proposes a new composition for the selection panel responsible for appointing the Chief Election Commissioner (CEC) and other Election Commissioners (ECs). 
  • The panel will now include:
    • The Prime Minister, who will serve as the chairperson.
    • The Leader of the Opposition, who will become a member of the panel.
    • A Union Cabinet Minister nominated by the Prime Minister.

Should the CJI be part of the committee selecting the CEC?

For  Against
  • If CJI is in the committee, then it will bring expertise.
  • Presence of CJI infringes on parliamentary sovereignty to decide the composition of the Parliamentary panel.
  • It will bring independence to the functioning of the Election Commission.
  • It will give rise to judicial activism.

Conclusion:

It is argued that the presence of CJI to be part of the committee selecting the CEC will enhance the trust of people in the Election Commission and help in deepening democracy.
