• The US opposes the ICC’s efforts to exercise jurisdiction over American citizens without its consent.
• Washington has criticised ICC investigations involving US military personnel in Afghanistan.
• The US has also opposed arrest warrants issued against Israeli Prime Minister Benjamin Netanyahu and other Israeli officials.

Impact of the Sanctions

• Operational challenges: May restrict the ICC’s access to US-based banking, software, insurance and other services.
• Economic uncertainty: Businesses may limit dealings with the court to avoid potential penalties.
• International tensions: Could strain US relations with European allies and other ICC member states.
• Judicial independence: Raises concerns about external pressure on international judicial institutions.

About the ICC

• Established: Created under the Rome Statute (1998); began functioning on 1 July 2002.
• Headquarters: The Hague, Netherlands.
• Nature: Permanent international court and a court of last resort that prosecutes individuals for serious international crimes.
• Jurisdiction: Four core crimes:
• 1. Genocide
  2. Crimes against humanity
  3. War crimes
  4. Crime of aggression
• Membership: 125 countries are States Parties to the Rome Statute of the International Criminal Court. India, the United States, China and Russia are not parties to the Rome Statute.
