Context: The public appreciation of Maharashtra FDA Commissioner Tukaram Mundhe’s crackdown on unsafe food establishments raises a larger governance question: why does routine enforcement of laws appear exceptional in India?

The Paradox of Public Appreciation

• Routine Duty as Heroism: Inspections, licence suspension and action against unsafe establishments are basic regulatory functions, yet they are often celebrated as extraordinary achievements.
• Declining State Capacity: Such enthusiasm reflects citizens’ growing experience of weak enforcement and administrative indifference.
• State Presence: Effective enforcement restores the public perception that the State is capable of protecting citizens.

• Unsafe Medicines: Fake drugs and unqualified medical practitioners can continue despite their serious public-health consequences.

Civil Service and Political Interference

• Transfer–Posting Pressure: Frequent transfers can become instruments of reward and punishment, discouraging independent action.
• Risk-Averse Bureaucracy: When taking principled action threatens tenure while inaction carries little cost, bureaucratic caution becomes rational.
• Political Responsibility: Elected governments must protect administrative neutrality and institutional independence.
• Bureaucratic Responsibility: Civil servants must also resist unlawful pressure, rule-bending and patronage networks.

The Limits of the “Hero Officer” Model

• Individual Heroism: Public admiration often focuses on exceptional officers who display courage and integrity.
• Institutional Weakness: Dependence on individual officers indicates that institutions are not functioning with sufficient consistency and autonomy.
• Singham Syndrome: A democracy cannot depend on finding a “Singham” every time enforcement is required.
• Institutionalisation: The objective should be to make effective governance routine rather than personality-driven.

What Should Good Regulation Look Like?

• Rule of Law: Regulatory action must remain lawful, transparent and accountable.
• Proportionality: Enforcement should be proportionate to the nature and severity of violations.
• Due Process: Strong enforcement must not become an excuse for arbitrary administrative action.
• Predictability: Businesses should know that violations will result in certain and credible consequences.
• Continuity: Effective enforcement should continue irrespective of the individual officer in charge.

Way Forward

• Transparent Transfers: Institutionalise objective and transparent transfer-posting mechanisms to reduce political interference.
• Regulatory Capacity: Strengthen staff, technology, inspection systems and prosecution mechanisms.
• Accountable Enforcement: Introduce time-bound investigations and penalties for regulatory violations.
• Whistle-blower Protection: Protect officials and citizens who expose corruption and regulatory violations.
• Citizen-Centric Governance: Establish accessible grievance-redressal and complaint mechanisms.
• Performance Accountability: Measure administration through outcomes and service delivery, not merely procedural compliance.
• Institutional Continuity: Ensure that effective practices become standard operating procedures rather than officer-specific initiatives.

The real achievement is not producing an “honest officer”, but creating an honest and effective institution. A mature democracy should ensure that law enforcement is predictable, professional and continuous, so that doing one’s constitutional and administrative duty is no longer considered exceptional.
