Delimitation, Women’s Reservation & Lok Sabha Expansion: Federal Concerns

Context: The debate over delimitation, women’s reservation and the possible expansion of the Lok Sabha has intensified ahead of the 2027 Census, raising concerns over federal balance and the political consequences of population-based seat redistribution.

Constitutional Framework of Delimitation

• Article 81: Provides for representation in the Lok Sabha broadly based on population, “so far as practicable”.
• Article 82: Mandates readjustment of seats and constituencies after each Census through parliamentary legislation.
• 42nd Constitutional Amendment Act, 1976: Froze inter-State allocation of Lok Sabha seats based on the 1971 Census to avoid penalising States that successfully implemented family planning.
• 84th Constitutional Amendment Act, 2001: Extended the freeze until the publication of figures from the first Census after 2026.
• Delimitation after 2001 Census: Constituency boundaries were reorganised within States without altering the inter-State allocation of seats.

Why Delimitation Raises Federal Concerns

• Population-based Imbalance: States with higher population growth, particularly Uttar Pradesh and Bihar, could gain greater parliamentary representation, while States such as Tamil Nadu and Kerala, which achieved demographic stabilisation, may face relative political dilution.
• Absolute Numerical Advantage: Even if the existing proportion of seats among States is maintained, a proportional increase can widen the absolute gap in parliamentary strength.
• Demographic Success Penalty: States that invested in education, healthcare and family planning fear being politically disadvantaged for achieving the demographic objectives encouraged by national policy.
• Federal Compact: The long-standing freeze created an implicit federal bargain that population stabilisation would not reduce a State’s parliamentary influence.

Why Lok Sabha Need Not Be Enlarged

• Boundary versus Seat Expansion: Delimitation can redistribute constituencies within States according to updated population figures without necessarily increasing the total number of Lok Sabha seats.
• Representation Burden: Larger constituencies already place a substantial accessibility burden on Members of Parliament; merely increasing the size of the House may not automatically improve the quality of representation.
• Parliamentary Deliberation: A substantially larger Lok Sabha could further reduce individual MPs’ opportunities for debate, questions and legislative scrutiny.
• International Examples: The United States House of Representatives has remained at 435 voting members for over a century despite substantial population growth, demonstrating that population growth does not mechanically require legislative expansion.

Women’s Representation

• Constitutional Objective: The one-third reservation for women in the Lok Sabha can be implemented within the existing strength of 543 seats.
• Core Principle: Women’s reservation seeks to change who occupies parliamentary seats, not necessarily to increase the total number of seats.
• Risk of Competing Objectives: Expanding the House could increase women’s representation numerically while simultaneously increasing the political dominance of populous States.

Alternative Approach

• Retain 543 Seats: Preserve the existing inter-State distribution of Lok Sabha seats.
• Updated Delimitation: Redraw constituencies within States using updated demographic data.
• Implement Women’s Reservation: Provide the constitutionally mandated one-third representation within the existing House.
• Strengthen State Legislatures: Increase the number of Members of Legislative Assembly and reduce constituency size to improve grassroots accessibility.
• Protect Federal Equity: Ensure that demographic success through population stabilisation does not translate into loss of political influence.

Way Forward

• Balanced Delimitation: Reconcile the constitutional principle of population-based representation with cooperative federalism.
• All-party Consensus: Build political consensus among States before undertaking a reform with long-term implications for the federal structure.
• Evidence-based Representation: Use the 2027 Census to correct intra-State disparities while avoiding unnecessary disruption of the existing inter-State balance.
• Multi-level Representation: Strengthen Panchayats, Urban Local Bodies and State Legislatures to address the growing representational burden rather than relying exclusively on expansion of Parliament.

Conclusion

Delimitation is necessary, women’s representation is overdue, and constituency boundaries must reflect demographic realities. However, these objectives need not require an 800-plus-member Lok Sabha. A balanced approach can preserve 543 seats, protect federal fairness, improve intra-State representation and enhance women’s political participation simultaneously.
