Milk Adulteration Tragedy in Andhra Pradesh: Ethylene Glycol Poisoning Case

A mass poisoning incident in Rajamahendravaram, Andhra Pradesh, caused by milk contaminated with ethylene glycol (an industrial chemical widely used as an antifreeze and coolant in refrigeration systems and chilling plants), led to 11 deaths and several hospitalisations.

Background

  • Negligence: Although the vendor was warned that the milk tasted bitter, they continued to supply it to avoid financial loss.
  • Vulnerable Populations: The impact was most severe on infants and the elderly.
    • Infants: Due to their high metabolic sensitivity, their bodies processed the ethylene glycol into toxic acids very rapidly.
    • Elderly: Their reduced kidney function made it difficult for their bodies to filter out the toxic compound.
  • Criminal Charges: Cases were registered under Sections 103 (murder) and 105 (culpable homicide not amounting to murder) of the Bharatiya Nyaya Sanhita (BNS), as the vendor allegedly knew of the contamination but continued sales.
  • Historical Parallel: This case draws comparisons to the 2008 Melamine milk scandal in China, where plastic chemicals in milk led to widespread illness in children, highlighting that milk adulteration is a recurring global challenge for regulators.

Structural Issues in the Dairy Supply Chain

  • Informal Market Dominance: A significant portion of India’s milk distribution occurs through small, unregulated vendors, with minimal monitoring.
  • Lack of Oversight: The dairy in Rajamahendravaram reportedly operated for 11 years without a licence, reflecting regulatory failure and the absence of regular inspections by local authorities and the Food Safety and Standards Authority of India (FSSAI).
  • Weak Safety Infrastructure: Lack of cold-chain systems, testing facilities, and regular hygiene inspections increases the risk of contamination.
  • Perverse Effects of Harsh Punishment: Excessive criminalisation may push small vendors out of the regulated system or deeper into informality, weakening oversight.
  • Deterrence Gap: The certainty and speed of punishment deter crime more than severity
    • The weak enforcement and delays reduce accountability despite calls for harsher penalties.

Way Forward

  • Subsidised Testing Kits: Provide affordable milk-testing kits to small dairies and vendors to enable regular quality checks and early detection of contamination.
  • Cooperative Chilling Centres: Establish government-supported cooperative chilling facilities that enable small vendors to pool resources and share refrigeration infrastructure.
    • This can improve cold-chain maintenance and enhance food safety standards.
  • Safe Harbour Provisions: Introduce reduced penalties for vendors who voluntarily report contamination early, enabling authorities to intervene before public harm occurs.

Conclusion

Effective food safety regulation depends on consistent detection of violations and timely enforcement of food safety laws and regulations, as these act as stronger deterrents than harsh penalties.
