Streamlining Indian Labour Laws

India’s efforts to ease the compliance burden on industries face substantial challenges, with over 20,000 obligations for companies operating across all states. 

Complex Compliance Landscape

  • Staggering Burden: Indian companies grapple with over 20,000 compliance obligations at central and state levels. Labor regulations contribute a disproportionate 56% of this burden.
  • LC Effectiveness Questioned: The new Labour Codes, consolidating 29 laws, are yet to be fully implemented. Their effectiveness in reducing the compliance burden and aligning with international labor standards is under scrutiny.

Key Challenges of New Labor Codes

  • Increased Business Costs: The redefined wage structure in LCs, capping variable pay at 50% of total compensation, could raise employment costs by 5-10% due to increased social security contributions. 
    • Regionally adjustable minimum wages further complicate multi-state operations.
  • Regulatory Ambiguity: Varying definitions of “worker” and “employee” in LCs create uncertainty, impacting benefit eligibility.
    • This is particularly problematic for highly compensated IT/ITeS sector employees, who may face stringent compliance requirements.
  • Dual Compliance Framework: LCs, while subsuming central laws, will still overlap with state-specific Shops and Establishments Acts. 
    • This creates a dual compliance framework, complicating adherence for businesses across sectors like technology and retail.
  • Inconsistent Requirements: A lack of uniformity in compliance obligations for record maintenance, filing, and display across states leads to confusion and increased administrative costs for multi-state businesses.
  • Fragmented Digitization: Differing levels of digitization and varied formats for compliance requests across states lead to inefficiencies. 
    • This results in redundancies, such as a significantly higher number of compliance forms in Maharashtra compared to Hyderabad.

Impact on Investment and MSMEs

  • MSME Challenges: India’s Micro, Small, and Medium Enterprises (MSMEs), vital contributors to GDP (30%) and employment (110 million+), face considerable challenges from this complex regulatory framework.
  • Deterrent to Investment: The complexity of labor law requirements may deter global companies from investing in India or lead them to concentrate operations in select states, undermining national operational efficiency and talent access.

Way Forward

  • Clarify Key Definitions: Introduce modern classification methodologies for “worker” and “employee,” based on salary and job role, aligning with international labor standards. Clearer wage definitions would also aid companies in compensation planning.
  • Integrate State Laws: Subsume state-specific Shops and Establishments Acts into the proposed Labour Codes. 
    • This would eliminate dual compliance frameworks, simplifying regulations for businesses operating across states.
  • Rationalize Applicability Thresholds: Implement sector-specific exemptions and regulations to streamline compliance burdens. 
    • This tailored approach would reduce unnecessary complexity for various industries.
  • Standardize Requirements: Standardize compliance requirements across states to reduce redundancy and confusion for businesses. 
    • Develop tailored compliance forms specific to industries for enhanced efficiency.
  • Implement Self-Certification: Introduce a self-certification scheme for certain compliance requirements. 
    • This initiative has the potential to reduce the overall compliance burden by a significant 15-20%.
  • Optimized Compliance and Litigation: Effective and timely implementation of these recommendations could optimize compliance burdens and litigations in labor laws by nearly 50%.

Conclusion

This significant reduction in compliance costs would enhance the overall ease of doing business in India. It would also promote investments in key sectors by creating a consistent and simplified regulatory framework across all states, fostering sustainable economic growth.
