Stem Cell Therapy Regulation in India: Supreme Court, MoHFW & Clinical Trials

Context: The Union Ministry of Health and Family Welfare (MoHFW) has issued an advisory to States and Union Territories on regulating stem cell therapy.

• Supreme Court Directives: The advisory has been issued in view of the judgment of the Hon’ble Supreme Court in Yash Charitable Trust & Ors. v. Union of India & Ors (January 2026).
  • The Court held that violations of the statutory framework may result in consequences, including professional misconduct under Regulation 7.22 of the Indian Medical Council (IMC) Regulations, 2002.
  • Action may also be taken under Sections 32 and 40 of the Clinical Establishments (Registration and Regulation) Act, 2010, including cancellation of registration and penalties.

Key Points of the Advisory

• Regulatory Framework: The advisory applies to States and Union Territories that have adopted the Clinical Establishments (Registration and Regulation) Act, 2010.
• Approved Indications: Stem cell therapy may be used as routine standard care only for approved indications specified by the Ministry of Health.
• Autism Spectrum Disorder (ASD): Use of any type of stem cell therapy for ASD is restricted to duly approved clinical trials.
• Clinical Trials: Such trials must comply with the National Guidelines for Stem Cell Research, 2017, issued jointly by the Indian Council of Medical Research (ICMR) and the Department of Biotechnology (DBT).
• Unproven Therapies: Unproven stem cell interventions, including those for ASD, cannot be offered as routine, standard or commercial clinical services outside the approved regulatory framework.
• Role of Regulatory Authorities: The Ministry has requested States and Union Territories to widely disseminate the Supreme Court’s directions to:
  • State and District Regulatory Authorities.
  • Government and private clinical establishments involved in stem cell research, treatment, promotion, or administration.
  • The concerned authorities and clinical establishments are required to ensure strict compliance with the applicable framework governing stem cell research and therapy.

• Stem cell therapy involves using stem cells to replace, repair, or regenerate damaged cells, tissues, or organs.

• • It is primarily aimed at treating conditions where damaged cells or tissues need to be replaced or restored.
  • Hematopoietic Stem Cell Transplantation (HSCT) is an established form of stem cell therapy used to treat various blood-related diseases, including leukemia, lymphoma, multiple myeloma, and aplastic anemia. 
• Concerns:
  • Safety Risks: Unproven therapies may cause infections, immune reactions, and abnormal tissue growth.
  • Lack of Evidence: Many applications lack sufficient evidence on safety and efficacy, particularly for conditions such as Autism Spectrum Disorder (ASD).
  • Commercial Misuse: Misleading promotion of unapproved therapies can exploit vulnerable patients and create false expectations.
