Context: Recent allegations against an acting Chief Justice of the Rajasthan High Court have renewed concerns over judicial integrity, accountability and transparency, highlighting the need to balance judicial independence with effective institutional oversight.

• Purpose: Ensures rule of law, constitutional governance and protection of fundamental rights.

Key Concerns

• Opaque Judicial Appointments: Lack of clearly articulated and publicly verifiable criteria can create concerns regarding transparency, merit and accountability in judicial appointments.
• Accountability Deficit: Existing mechanisms for addressing allegations against higher judiciary are often viewed as slow, cumbersome or ineffective.
• Conflict between Independence and Accountability: Strong safeguards against external interference are necessary, but excessive insulation can create perceptions of institutional impunity.
• In-house Mechanism Limitations: Internal mechanisms may lack sufficient transparency, independence and enforceability, particularly when allegations concern senior judicial functionaries.
  • The Judges (Inquiry) Act, 1968, is inadequate to tackle the issue and has, for all practical purposes, become defunct.
• Impeachment as a Limited Remedy: The constitutional removal process requires a very high parliamentary threshold, making impeachment an exceptional and difficult mechanism.
• Public Trust Deficit: Allegations of favouritism or corruption, even when unproven, can undermine public confidence in the judiciary.
  • Transparency International’s Findings: Its 2002 household survey identified the judiciary as the second-most corrupt institution in India and some other South Asian countries, highlighting a public trust deficit in judicial institutions. 
• Administrative Concentration of Power: The role of the Chief Justice as Master of the Roster gives significant administrative control over allocation of cases, making transparency in roster management important.

Way Forward

• Transparent Appointments: Establish clearer, objective and publicly defensible criteria for judicial selection while preserving judicial independence.
• Strengthen In-house Mechanism: Make internal investigations time-bound, credible and procedurally transparent.
• Independent Oversight: Explore an appropriately designed institutional mechanism for investigating serious allegations without enabling executive interference.
• Roster Transparency: Institutionalise transparent principles for case allocation and roster management.
• Ethical Standards: Strengthen adherence to the Restatement of Values of Judicial Life and judicial ethics.
• Prompt Institutional Response: Allegations supported by credible material should receive timely preliminary examination rather than prolonged silence.
• Balance Independence with Accountability: Reforms should ensure that judicial independence becomes a shield against interference, not a shield against legitimate scrutiny.
