Restoration of Statehood in J&K: Constitutional Framework and Federalism

Context: On 25 September 2026, Jammu & Kashmir Chief Minister moved a resolution in the Legislative Assembly seeking the immediate restoration of full statehood, bringing the issue of federalism and democratic representation back into focus.

Background to the Reorganisation of J&K

  • 2019 Reorganisation: In 2019, the constitutional changes concerning Article 370 were accompanied by the Jammu and Kashmir Reorganisation Act, 2019, which reorganised the former State into the Union Territories of Jammu & Kashmir and Ladakh.
  • Change in Constitutional Status: The erstwhile State’s institutional structure was substantially altered, including the transition from a State to Union Territory administration.
  • Federalism Question: The development raised broader constitutional questions concerning federalism, representative government and the relationship between the Union and States.

Supreme Court and Restoration of Statehood

  • 2023 Judgment: In its judgment on the Article 370 challenge, the Supreme Court upheld the constitutional changes and observed that statehood of Jammu & Kashmir should be restored at the earliest.
  • Election Direction: The Court directed that legislative assembly elections be held by 30 September 2024.
  • No Fixed Statehood Deadline: Importantly, the judgment did not prescribe a specific deadline by which statehood had to be restored.
  • Constitutional Significance: The issue therefore involves the balance between Union powers, representative institutions and the restoration of a State-level constitutional structure.

Return of Electoral Politics

  • Assembly Elections: Jammu & Kashmir held Assembly elections in 2024, the first Assembly election in the Union Territory since the 2019 reorganisation.
  • Voter Participation: Overall turnout was 63.88%, with the third phase recording 69.69% turnout.
  • Representative Government: An elected government was subsequently formed, restoring an important layer of representative political institutions in the Union Territory.
  • Democratic Participation: The elections provided an institutional channel for political parties and citizens to articulate demands through constitutional and electoral mechanisms.

2026 Statehood Resolution

  • Demand for Restoration: On 25 September 2026, the Chief Minister moved a resolution calling for the immediate and urgent restoration of full statehood to Jammu & Kashmir.
  • Earlier Resolutions: The resolution referred to an earlier 26 June 2000 autonomy resolution and a 6 November 2024 resolution on restoration of special status, making the current demand part of a longer political history.
  • Political Contestation: BJP legislators opposed the resolution, particularly its reference to the earlier autonomy resolution, demonstrating that statehood and autonomy are politically distinct but interconnected issues.
  • Institutional Route: The present demand is being articulated through the elected Legislative Assembly, rather than through extra-constitutional methods.

  • Balanced Approach: Security management and democratic governance should therefore be viewed as parallel constitutional objectives, rather than necessarily sequential ones.

Way Forward

  • Follow Constitutional Processes: Any decision on statehood should operate through the constitutional and statutory framework governing Jammu & Kashmir.
  • Strengthen Representative Institutions: Ensure effective functioning of the Legislative Assembly and local democratic institutions.
  • Maintain Security Safeguards: Continue effective measures against terrorism, infiltration and organised violence.
  • Promote Inclusive Governance: Strengthen participation of different regions, communities and political groups in governance.
  • Build Institutional Trust: Maintain dialogue between the Union Government and elected J&K institutions on governance, development and constitutional issues.
  • Separate Governance from Short-Term Fluctuations: Institutional arrangements should provide predictability and continuity while remaining responsive to security realities.
