Uniform Civil Code: Equality, Religious Freedom & Constitutional Balance

Context: The debate over the Uniform Civil Code (UCC) has gained renewed attention as states move towards common civil frameworks governing marriage, divorce, inheritance, adoption and related matters. Uttarakhand has already implemented its UCC framework, while Gujarat passed its UCC Bill in March 2026.

Understanding the Uniform Civil Code

  • Civil vs Criminal Law: India’s criminal law applies broadly across citizens, whereas aspects of marriage, divorce, adoption, succession and inheritance have historically been governed through a combination of personal and secular laws.
  • Common Civil Framework: UCC seeks to establish common legal principles for specified civil and family matters, irrespective of religious identity.
  • Intestate Succession: It also concerns succession when a person dies without leaving a valid will, including determination of legal heirs and distribution of property.
  • Religious Freedom: A UCC concerns civil consequences of personal relationships; it does not necessarily require uniformity in religious beliefs, worship or religious practices.

Constitutional and Legal Framework

  • Article 44: The Directive Principles state that the State shall endeavour to secure a Uniform Civil Code for citizens throughout India.
  • Concurrent List: Under Entry 5 of the Concurrent List, Parliament and State Legislatures can legislate on marriage, divorce, adoption, succession and related matters.
  • Fundamental Rights: UCC debates involve balancing Article 14 equality, Article 15 non-discrimination, and Article 25 freedom of conscience and religion.
  • Law Commission: The 21st Law Commission’s 2018 consultation process treated reform of discriminatory aspects of personal laws as an important issue; the 22nd Law Commission reopened consultation on UCC in 2023.

Arguments Supporting a Common Civil Framework

  • Gender Justice: Supporters argue that common civil standards can address discriminatory provisions affecting women in areas such as marriage, divorce and inheritance.
  • Legal Certainty: Harmonised rules can potentially reduce conflicting provisions and interpretative complexity across personal-law systems.
  • Constitutional Equality: A common framework can strengthen the application of equality and non-discrimination principles in civil matters.
  • Social Reform: Reform can help legal systems respond to changing realities involving women’s employment, family structures, adoption and changing forms of relationships.

Concerns and Challenges

  • Article 25: A major constitutional question is how far civil-law uniformity can be pursued while protecting freedom of conscience and religious practice.
  • Cultural Diversity: India’s communities possess diverse customary practices and family traditions, making a single framework legally and socially complex.
  • Tribal Customs: Constitutional protections for tribal communities and customary practices require careful consideration while designing any common civil framework.
  • Federalism: Since family-law subjects fall in the Concurrent List, differences between Central and State legislation can create questions of legislative coordination and legal consistency.

State-Level Implementation

  • Uttarakhand: The state enacted its UCC framework in 2024, with the 2025 Rules providing procedures relating to marriage, divorce, inheritance, succession and live-in relationships.
  • Gujarat: Gujarat passed its UCC Bill in March 2026, becoming the second state after Uttarakhand to take this legislative step.
  • Implementation Model: The Uttarakhand framework demonstrates how UCC can operate through state legislation and administrative rules, rather than requiring an immediate nationwide code.
  • Policy Debate: The expansion of state-level initiatives raises questions about uniformity, inter-state legal differences and coordination with existing personal laws.

Way Forward

  • Consultative Approach: Reform should involve consultation with women’s groups, religious communities, tribal representatives, legal experts and civil society.
  • Rights-Based Reform: Priority should be given to eliminating demonstrably discriminatory practices while protecting constitutionally guaranteed freedoms.
  • Gradual Harmonisation: A phased approach can first address common areas of discrimination and gradually harmonise civil laws.
  • Constitutional Balance: UCC implementation should maintain a balance between equality, gender justice, religious freedom and cultural diversity.
  • Legal Clarity: Clear legislative drafting and coordination between Centre and States are essential to prevent jurisdictional conflicts and legal uncertainty.
