  • Judicial Observation: The Court noted dowry’s roots in patriarchal hypergamy, caste hierarchies, and social status anxieties that commodify women across communities.

Key Recommendations of the Supreme Court

  • Educational Reforms: The Court directed the Union and States to revise school and higher education curricula to reinforce constitutional values of gender equality and equal partnership in marriage.
  • Reframing Dowry as Unconstitutional: It held dowry to be fundamentally incompatible with Articles 14 and 21, as it reduces women to sources of financial extraction, violating dignity and equality.
  • Strengthening Implementation of Law: States were ordered to promptly appoint Dowry Prohibition Officers and ensure public access to their details for accountability and enforcement.
  • Capacity Building of Institutions: Police and judicial officers handling dowry cases must undergo regular training and sensitisation to address gender bias and improve prosecution quality.
  • Speedy Justice: High Courts were asked to assess pendency of dowry cases and take steps for their expeditious disposal, ensuring timely justice to victims.
    • The court ordered the copy of the judgment to be circulated among the High Courts.
