• It was enacted to prevent disrespect and insults to India’s National Flag, Constitution, and National Anthem, thereby preserving their dignity and sanctity.
• Legal Basis: Provides statutory protection to national symbols in addition to the Fundamental Duty under Article 51A(a), which requires every citizen to respect the Constitution, the National Flag, and the National Anthem.

• Key Provisions:
  • Prohibits intentional insult to the National Flag or the Constitution of India through acts such as burning, mutilating, defacing, defiling, disfiguring, destroying, trampling upon, or showing contempt.
  • Prohibits intentional prevention or disturbance of the singing of the National Anthem.

• Freedom of Speech: Criminalising certain conduct may invite scrutiny under Article 19(1)(a) relating to freedom of speech and expression, subject to reasonable restrictions under Article 19(2).
• Legislative Competence Debate: Some members contend that the Bill effectively alters a constitutional understanding without a constitutional amendment.
