Context: The Contrasting Supreme Court approaches towards elephants and street dogs raise questions about equal moral consideration, animal welfare and anthropocentric bias in India’s legal framework.

Contrasting Judicial Approaches

• Elephant Welfare: In Jayakrishna Menon vs. Krishnankutty, the Supreme Court stressed that animal wellbeing is of paramount importance and directed the Kerala government to take custody of Raman.
• Street Dogs: In Re: City Hounded by Strays, Kids Pay Price, the Court adopted a more human-safety-oriented approach, leading to removal of large numbers of street dogs from public institutions.
• Core Concern: Similar concerns of animal suffering have received different judicial treatment.

Why the Difference Exists

• Legal Status: Elephants are protected as Endangered Species under the International Union for Conservation of Nature framework and receive explicit protection under the Wild Life (Protection) Act, 1972.
• Street Dogs: They are primarily regulated under the Prevention of Cruelty to Animals Act, 1960 and rules concerning management of stray animals.
• Human Interaction: Elephants are primarily wildlife, whereas street dogs share public spaces with humans, creating concerns relating to safety, public health and coexistence.
• Different Legal Categories: Different species consequently attract different legal protections and regulatory approaches.

• Equal Consideration ≠ Equal Treatment: Equality does not require identical treatment of all animals.
• Capacity to Suffer: Beings capable of experiencing pleasure or pain deserve moral consideration.
• Needs-Based Approach: Different animals may require different rights and treatment, but their interests should first be considered fairly.
• Key Issue: Differential treatment becomes problematic when it reflects an absence of equal consideration, rather than genuine differences in needs and circumstances.

Anthropocentric Bias in Law

• Human-Centred Framework: Existing laws often determine animal protection based on human interests, utility and perceived value.
• Wildlife Protection: Protection may be stronger for charismatic or endangered species.
• Urban Animals: Street animals are often viewed primarily through the lens of public nuisance, safety and human convenience.
• Legal Gap: India lacks a comprehensive framework recognising the intrinsic worth and welfare of animals across categories.

Way Forward

• Comprehensive Legislation: Develop stronger legislative principles for the welfare and dignity of all sentient animals.
• Equal Moral Consideration: Assess animal welfare based on capacity to suffer, needs and circumstances, rather than species popularity.
• Ethical Coexistence: Promote scientifically informed human-animal coexistence in shared spaces.
• Clear Judicial Standards: Provide courts with consistent legislative guidance for balancing animal welfare with legitimate human interests.
• Institutional Responsibility: Parliament should establish a stronger legal foundation recognising animals as beings worthy of independent moral consideration.
