Article 348: Supreme Court Language, Hindi and Access to Justice

GS Paper II: Structure, organization, and functioning of the Judiciary

Context: The Supreme Court’s rejection of a Public Interest Litigation (PIL) seeking a commission to examine the use of Hindi as an official court language has renewed debate over linguistic accessibility, Article 348 of the Constitution, and the need to balance inclusive justice with uniform judicial functioning.

Constitutional Framework Governing Court Languages

  • Article 348(1): Until Parliament provides otherwise by law, proceedings in the Supreme Court and High Courts, along with authoritative legal texts specified under the provision, are to be in English.
  • Article 348(2): The Governor of a State, with the previous consent of the President, may authorise Hindi or another official language of the State for proceedings in its High Court. This provision does not extend to High Court judgments, decrees, or orders.
  • Official Languages Act, 1963: Section 7 permits the use of Hindi or a State’s official language for High Court judgments, decrees, and orders, subject to the prescribed authorisation and publication of an English translation.
  • Parliamentary Authority: Changing the constitutional framework governing the language of Supreme Court proceedings would require appropriate legislative and, where necessary, constitutional action. The judiciary cannot independently rewrite the constitutional scheme.

Recent Supreme Court Development

  • PIL Dismissal: On 25 September 2026, the Supreme Court dismissed a PIL seeking the constitution of a commission to examine making Hindi an official language of the Court.
  • Constitutional Limitation: The proceedings highlighted that the language of the Supreme Court is governed by a specific constitutional framework and cannot be changed simply through an administrative direction.
  • Access to Justice: The debate is not merely about the choice of language; it concerns whether litigants can understand judgments, legal procedures, and their rights.
  • Linguistic Diversity: A common working language facilitates communication among judges and lawyers from different States, while multilingual access can reduce barriers for citizens unfamiliar with English.

Why a Common Judicial Language Matters

  • Uniformity: A common language supports consistent communication across the national judicial system and reduces the risk of misunderstanding during proceedings.
  • Pan-India Access: Lawyers and judges from different linguistic backgrounds can participate in proceedings without requiring fluency in every regional language.
  • Legal Precision: Uniform legal terminology helps maintain consistency in interpreting statutes, precedents, and constitutional provisions.
  • Judicial Efficiency: A common working language can reduce delays and translation-related complications in complex litigation.

Challenges in Ensuring Linguistic Accessibility

  • Language Barriers: Many litigants struggle to understand legal documents and judgments written in English.
  • Unequal Access: Language proficiency can affect a litigant’s ability to communicate with lawyers and understand legal remedies.
  • Translation Accuracy: Legal translation requires precision because differences in terminology can alter the interpretation of legal rights and obligations.
  • Federal Diversity: Promoting one Indian language without adequate safeguards may create barriers for citizens from other linguistic regions.
  • Institutional Constraints: Changing the language of higher judiciary proceedings requires trained personnel, reliable translation systems, and consistent legal terminology.

Technology as a Bridge to Justice

  • Supreme Court Vidhik Anuvaad Software (SUVAS): The Supreme Court has used SUVAS, an artificial intelligence-assisted translation tool, to translate judicial documents into Indian languages, improving access to legal information.
  • Multilingual Judgments: Translation of judgments can help litigants understand judicial reasoning without requiring an immediate change in the language of court proceedings.
  • Digital Accessibility: Searchable translations, regional-language legal databases, and accessible digital platforms can improve awareness of rights and remedies.
  • Human Verification: Machine-generated legal translations should be reviewed for accuracy, particularly where interpretation affects constitutional rights or binding legal principles.

Way Forward

  • Strengthen Translation Infrastructure: Expand reliable translation of judgments, orders, and legal information into Indian languages.
  • Preserve Linguistic Inclusion: Ensure that reforms improve access for speakers of different regional languages rather than privileging one linguistic group.
  • Maintain Legal Accuracy: Develop standardised legal glossaries and expert verification mechanisms for translated documents.
  • Improve Legal Literacy: Provide multilingual information on court procedures, legal aid, and available remedies.
  • Respect Constitutional Boundaries: Pursue changes to the language framework through constitutionally appropriate legislative processes.

Conclusion

Justice must not only be delivered but also understood. A combination of constitutional compliance, accurate multilingual translation, and accessible legal technology can improve inclusion without undermining the uniform functioning of the higher judiciary.
