Key Concepts

  • Adjournment sine die: The presiding officer ends a sitting of the House without fixing a date for its next sitting. It does not formally terminate the parliamentary session.
  • Adjournment Sine DieProrogation: The President formally terminates a session of Parliament under Article 85(2)(a), generally acting on the advice of the Council of Ministers.
  • Inter-session Period: The period between prorogation of one session and commencement of the next session.

Constitutional Framework

  • Article 85: The President summons Parliament and may prorogue either House. The President may also dissolve the Lok Sabha.
  • Article 85(1): Not more than six months can intervene between the last sitting of one session and the first sitting of the next session.
  • Article 85(2): The President may prorogue the Houses or either House and dissolve the Lok Sabha.

Why Has the Delay Attracted Attention?

  • No Fixed Constitutional Deadline: The Constitution does not prescribe a specific number of days within which a House must be prorogued after being adjourned sine die.
  • Parliamentary Convention: Prorogation usually follows adjournment sine die within a few days, although longer gaps have occurred. 
    • A Congress leader noted that the gap has previously extended to 28 days in 2015 and 20 days in 2021.
  • Political Speculation: The present delay has triggered speculation that the government may be keeping the session technically alive while assessing numbers for a possible delimitation-linked Constitutional Amendment Bill, which would require a special majority
    • This remains a political allegation, not an established reason for the delay.

Why Does Prorogation Matter?

  • Formal Closure: It legally ends the parliamentary session.
  • Inter-session Period: The period between prorogation and the next session begins only after formal closure.
  • Constitutional Continuity: It preserves the distinction between ending a sitting, ending a session, and ending the Lok Sabha itself.
  • Political Significance: A technically continuing session can have implications for the timing of a possible special session or legislative business.

Conclusion

The current episode highlights an important aspect of Indian parliamentary procedure: Parliament may stop sitting without the session having formally ended. While the 10-day delay is politically unusual and has invited speculation, there is no constitutional rule requiring immediate prorogation after adjournment sine die.
