Digital Hawala: FATF Findings, Money Laundering & Terror Financing

Context: The Financial Action Task Force (FATF) has flagged the emergence of “digital hawala” in its recent report.

  • Nearly 70% of surveyed jurisdictions reported the integration of new technologies into traditional hawala and other underground banking networks.

Digital Hawala

  • Prevalence of Hawala Networks: Nearly 90% of surveyed jurisdictions reported that hawala networks operate within their territories.
  • Money Laundering Channel: Over 80% identified hawala as a principal channel for professional money laundering.
  • National Risk: Over 60% considered hawala a heightened risk at the national level.
  • Impact of De-risking and Enforcement: Bank de-risking and overly punitive enforcement can push legitimate users and licensed Money or Value Transfer Services (MVTS) towards informal channels.

About Digital Hawala

  • Digital hawala refers to the use of digital technologies to coordinate, execute, settle, or conceal transactions within traditional informal value-transfer networks.
  • Impact of Digitisation: Digitisation is not replacing traditional hawala; rather, it is making such networks faster, more opaque, complex and geographically extensive, while cash remains important at collection and exit points

Six Forms of Digital Hawala

  • Digital coordination and traditional settlement: Encrypted messaging, shared digital ledgers and online platforms are used to coordinate transactions, while settlement remains through cash/trade.
  • Digital customer interface: Mobile wallets and fintech apps facilitate customer interaction, while operators settle through cash or trade.
  • Virtual-asset settlement: Stablecoins and other virtual assets are used to settle balances directly.
  • Formal digital infrastructure: Payment service providers, fintech platforms, and virtual International Bank Account Numbers (IBANs) are used to move funds.
  • AI-enabled operations: AI can facilitate automated transaction structuring, mule-account routing and rapid fiat–crypto conversion.
  • Hawala apps/ecosystems: Integrated platforms may combine messaging, cloud storage, social media, Virtual Asset Service Providers (VASPs), lending and gaming services.

Reasons For Digital Hawala Being a Concern

  • Greater anonymity and opacity: Access-controlled digital platforms make networks harder to trace.
  • Faster movement of funds: Digital tools enable rapid cross-border transfers.
  • Hybrid financial channels: Criminal networks can combine cash, trade, banks, fintechs, and crypto assets.
  • Terror financing: Digital hawala networks can facilitate financing of terrorist organisations.
  • Professionalisation: Networks increasingly operate through hierarchical, business-like structures with digitised records and professional intermediaries.

About FATF

  • The Financial Action Task Force (FATF) is an intergovernmental organisation founded in 1989 on the initiative of the G7 to develop policies to tackle money laundering (ML), terrorist financing (TF), and proliferation financing. 
  • Membership
    • 40 members: 38 jurisdictions and 2 regional organisations: the European Commission and the Gulf Cooperation Council (GCC).
    • India: Became a FATF member in 2010.
    • Russia: FATF suspended membership of the Russian Federation on 24 February 2023
  • Key Functions: 
    • Sets global standards through the 40 FATF Recommendations to combat ML, TF, and proliferation financing.
    • Evaluates countries through mutual evaluations and follow-up processes.
    • Identifies emerging threats and new methods of illicit financing.
    • Promotes international cooperation against illicit financial flows.
  • FATF Lists:
    • If a country repeatedly fails to implement the FATF Standards, it can be placed on the grey and black lists.
    • Black List- “High-Risk Jurisdictions subject to a Call for Action”: FATF calls for enhanced due diligence and, in serious cases, countermeasures.
    • Grey List – “Jurisdictions under Increased Monitoring”: They are subject to increased monitoring until deficiencies are resolved.
