About Digital Arrests Scam

• Definition: Digital arrests refer to a cyber-enabled extortion scam in which criminals impersonate law-enforcement agencies and coerce victims into virtual confinement through continuous video calls and psychological intimidation.
• Modus Operandi: Scammers claim that the victim is involved in a crime, demand verification through video calls, and force the victim to isolate in a room, cut communication with family, and follow their instructions.

• Call for Ratifying UN Cybercrime Convention: The Court underlined that combating cybercrime requires collective global law-enforcement efforts.
• Court’s Observation: The Court of the UN Convention against Cybercrime stressed that ratification is vital for tracking money trails and strengthening cross-border cyber investigations.’

About the United Nations Convention against Cybercrime (UNCC)

• First Global Cybercrime Treaty: This is the world’s first legally binding international criminal justice treaty dedicated to combating cybercrime.
• Objective: The Convention seeks to improve the prevention and effective control of cybercrime, strengthen international cooperation, and support technical assistance and capacity-building for States.
• Secretariat: The United Nations Office on Drugs and Crime (UNODC) will act as the secretariat to the Conference of the States Parties.
• Implementation: A Conference of States Parties will be responsible for overseeing compliance, assessing progress, and adopting any future protocols under the Convention.
• The treaty will enter into force once it receives ratification from 40 States.
  • India has not signed the UN Convention against Cybercrime.

Key Provisions of the Treaty

• Global Framework for Cybercrime Response: The Convention establishes a unified framework to support investigations, prosecutions and judicial processes, covering areas such as extradition, joint operations and asset recovery.
• Enhanced International Cooperation: It enables cross-border access to electronic evidence through mechanisms such as data preservation, data access and interception, backed by a 24/7 contact point network for urgent assistance.
• Criminalisation of Cyber Offences: The treaty covers:
  • Cyber-dependent offences,
  • Cyber-enabled crimes including unauthorised access, data interference, online fraud, and the non-consensual sharing of intimate images.
• Protection of Children Online: A major focus is on combating online child sexual exploitation, including the distribution of abuse material and the online solicitation or grooming of minors for sexual offences.
• Jurisdictional Rules: States are required to assert jurisdiction over offences committed on their territory or affecting their nationals.
  • If extradition is not feasible, States must take action against offenders present within their jurisdiction.
  • When multiple jurisdictions are involved, States must consult to avoid conflicts.
• Inter-State Cooperation in Investigations: Member States must cooperate on investigations through extradition, mutual legal assistance and sharing of electronic evidence.
• Procedural Powers: The treaty authorises States to preserve, search, seize and produce electronic data and to intercept data in transit, while ensuring adherence to human rights obligations.
• Procedural Safeguards: These powers must be exercised under strict safeguards, including judicial oversight, clear justification, limited scope, access to remedies, and measures to protect evidence integrity and fundamental rights.
