Context: India’s legal publishing system remains fragmented and heavily dependent on PDFs, making it difficult for citizens, lawyers, and courts to access, search, and track laws and amendments in force.

About Legal Publishing System

  • The framework and processes through which governments draft, publish, update, consolidate, and disseminate legal documents such as Acts, Bills, rules, regulations, notifications, circulars, and subordinate legislation.
  • It ensures that legal documents are officially authenticated, accessible, and kept up to date for citizens and other stakeholders.

Key Issues with India’s Legal Publishing System

  • Fragmented Legal Information: Laws, amendments, rules, regulations, BIS standards, road standards, circulars, and municipal bylaws are scattered across multiple websites.
    • There is no single authoritative platform providing the law currently in force.
  • Limited Public Access: Bills are often not placed in the public domain before introduction in Parliament or State Legislatures.
    • Citizens face difficulty in identifying the applicable law and its amendments at a given point in time.
  • Reliance on PDF-Based Publishing: Government gazettes are primarily published as PDFs.
    • PDFs preserve document appearance but fail to capture the hierarchical structure of legal texts (chapters, parts, sections, subsections).
    • Many regional-language gazettes use proprietary fonts, making them difficult to search or reuse digitally.
  • Problems in Tracking Legal Changes: Determining whether amendments have been notified and are in force is cumbersome.
    • Example: Some provisions of the Code of Criminal Procedure (Amendment) Act, 2005 remain unenforced because the required government notifications were never issued.

Global Best Practices

  • Akoma Ntoso Standard: An open XML-based markup language designed specifically for legal documents. 
    • It captures the structure, semantics, and version history of laws.
    • Enables users to: Track amendments, View laws as they existed on any given date, Link subordinate legislation with principal Acts.
    • Many African countries use Akoma Ntoso along with the Indigo open-source legal publishing platform.
  • United States:  Uses USLM (United States Legislative Markup), a variant of Akoma Ntoso.
    • Laws are published in structured markup, while PDF and HTML versions are automatically generated.
    • Legal data is available for bulk download, enabling wider public use.
  • United Kingdom: Publishes legislation through Crown Legislation Markup Language (CLML).
    • Plans to transition towards Akoma Ntoso, citing its international acceptance and simpler implementation.

Way Forward

  • Adoption of Open Legal Publishing Standards: Transition from PDF-based publishing to structured, machine-readable legal documents using open standards.
  • Improved Accessibility: Enable easy search, retrieval, tracking, and version-wise access to laws and amendments.
  • Enhanced Transparency: Ensure the timely publication of Bills, laws, amendments, and notifications in the public domain.
  • Strengthened Rule of Law: Provide citizens, lawyers, judges, and administrators with accurate, authentic, and up-to-date legal information.
  • Greater Democratic Participation: Facilitate informed public participation in the legislative process by improving access to laws.
