What is Delimitation? (UPSC CSE Prelims 2012 & 2024)

• Delimitation is the process of redrawing the boundaries of territorial constituencies for the Lok Sabha and State Legislative Assemblies to ensure broadly equal representation based on population.
• Constitutional Basis: Articles 82 and 170 provide for readjustment and delimitation of parliamentary and Assembly constituencies after every census, subject to constitutional provisions governing when such readjustment can take effect.

• Delimitation Commission: Delimitation is carried out by an independent Delimitation Commission established under an Act of Parliament. 
• Four Commissions: India has constituted four Delimitation Commissions so far — 1952, 1962, 1972 and 2002.
• Legal Status: The Commission’s orders cannot be challenged in any court, and once laid before Parliament or State Legislatures, they cannot be modified by them.

Why Has Delimitation Become Contentious?

• Population-control Dilemma: Southern States such as Tamil Nadu, Kerala, Karnataka and Andhra Pradesh have generally performed better in population stabilisation than several northern States.
• Representation Concern: If parliamentary representation is redistributed strictly according to population, States that achieved lower population growth could potentially experience a relative decline in their share of Lok Sabha seats, while States with higher population growth could gain greater representation.
• Political Incentive Problem: This creates a perceived “population-control penalty”, where successful implementation of family-planning policies could result in reduced political weight in Parliament.
• Federal Concern: Since Lok Sabha representation directly influences national political power, changes in seat allocation can affect the balance between States, regions and the Union.
• Rewarding Demographic Performance: Critics argue that representation should not create incentives for States to disregard population stabilisation and reproductive health objectives.
• Developmental Concerns: Southern States argue that they have contributed significantly to economic growth, revenue generation, human development and population stabilisation, and should not lose political weight because of these achievements.

Arguments in Favour of Delimitation

• Equal Representation: Delimitation can address disparities in the population represented by each MP, thereby strengthening the principle of “one person, one vote”.
• Democratic Fairness: States with rapidly growing populations may argue that their citizens are currently under-represented relative to population size.
• Constitutional Requirement: Periodic readjustment is envisaged by the Constitution to ensure that electoral constituencies remain broadly aligned with population changes.
• Political Representation: Updating constituencies can ensure that the Parliament reflects contemporary demographic realities rather than historical population patterns.

Way Forward

• Balanced Delimitation Formula: Develop a formula that combines population, demographic performance, development indicators and federal equity rather than relying exclusively on population.
• Protect Population Stabilisation Gains: States that achieved successful fertility reduction and population stabilisation should not face disproportionate political disadvantages.
• Gradual Transition: Consider a phased adjustment rather than an abrupt redistribution of seats.
• Expand Parliamentary Strength: If constitutionally and politically feasible, increasing the overall strength of the Lok Sabha could reduce the extent of representation losses or gains faced by individual States.
• Immediate Women’s Reservation: Explore mechanisms to ensure that 33% reservation for women is implemented without unnecessary delay while remaining consistent with the constitutional framework.
• Inter-State Consultation: Establish a sustained mechanism for dialogue among the Union and State governments, political parties and constitutional experts before undertaking major delimitation changes.
• Strengthen Cooperative Federalism: Delimitation should be approached not merely as an electoral exercise but as a question of federal balance, democratic equality and equitable representation.
