Context: The European Union Artificial Intelligence Act entered into force in August 2024, with major provisions applying from August 2, 2026, creating an opportunity for India to develop a global hub for AI compliance, testing and conformity assessment.

About EU AI Act

The European Union Artificial Intelligence Act adopts a risk-based regulatory framework, imposing obligations according to the potential risk posed by AI systems

  • Prohibited AI: Bans unacceptable AI practices that pose serious risks to fundamental rights and safety.
  • High-risk AI: Covers AI used in sensitive areas such as employment, education, critical infrastructure, biometrics and migration, requiring risk management, documentation, testing, data governance and human oversight.
  • Transparency-risk AI: Requires users to be informed when they interact with AI and requires machine-readable labelling of certain AI-generated or manipulated content, including deepfakes.
  • General-Purpose AI: Providers must meet technical documentation, copyright and training-data transparency requirements; models posing systemic risks face additional obligations for risk assessment, model evaluation, incident reporting and cybersecurity.

Why It Matters for India

  • Compliance Challenge: Indian IT-service companies and Global Capability Centres (GCCs) often provide customised and evolving AI solutions. Substantial modifications to high-risk AI systems may create additional regulatory responsibilities.
  • Emerging Compliance Market: The Act is likely to increase demand for risk assessment, technical documentation, testing, auditing, governance and conformity assessment.
  • India’s Advantage: India’s established IT and professional-services ecosystem can leverage expertise in technology, cybersecurity, data protection, auditing and regulatory compliance.
  • Employment & Exports: This could create demand for AI-law, cybersecurity, auditing and standards professionals and enable AI compliance-as-a-service as a new knowledge-intensive export.
  • Beyond Consultancy: With appropriate EU arrangements, accreditation and recognition, qualified Indian conformity-assessment bodies could potentially participate in the wider EU AI assurance ecosystem.
  • Strategic Opportunity: India–EU regulatory cooperation, including through the India–EU Free Trade Agreement, could help India expand from technology services into AI assurance and compliance services.

Key Regulatory Challenge and India’s Preparedness

  • Substantial Modification: A high-risk AI system may require a fresh conformity assessment when an unanticipated substantial modification affects its compliance or intended purpose.
  • Conformity Assessment: Demonstrates regulatory compliance through testing, technical documentation, risk management and human oversight before market placement.
  • Assessment Mechanism: Most high-risk AI providers can undertake self-assessment, while certain biometric AI systems require an independent notified body.
  • Institutional Capacity: India needs internationally credible AI testing and conformity-assessment institutions.
  • Skill Development: Greater availability of professionals trained in AI governance, technical standards and regulatory compliance is essential.
  • International Recognition: Indian assessment bodies must demonstrate independence, competence, transparency and reliability.
  • Evolving Standards: Rapid advances in AI technology and regulation require continuous upskilling and institutional adaptation.
  • Regulatory Coordination: Strong cooperation among government, industry, standards bodies and international regulators will be crucial.

Way Forward

  • Build AI compliance capabilities: Develop expertise in AI auditing, risk assessment, testing, documentation and governance.
  • Develop assessment institutions: Establish internationally credible conformity-assessment and certification mechanisms.
  • Deepen India-EU cooperation: Use the trade and regulatory framework to pursue cooperation on AI standards and conformity assessment.
  • Create multidisciplinary talent: Integrate AI, law, cybersecurity, ethics, auditing and data governance in professional training.
  • Support Indian firms: Enable start-ups, IT companies and GCCs to comply efficiently with emerging global AI regulations.
  • Shape global standards: Increase India’s participation in international AI standard-setting processes.
