Inter-State Council (Article 263): Composition, Functions and Role in Resolving Inter-State Disputes

Article 263 of the Indian Constitution establishes the Inter-State Council (ISC) to address inter-State issues and foster harmonious relations between the States and the Union. Chaired by the Prime Minister, the ISC serves as a platform for dispute resolution, collaborative policymaking, and policy coordination. Its structured procedure ensures efficient discussions and consensus-based decision-making, enhancing regional and national cooperation.

Article 263: Provisions for Establishing an Inter-State Council

  • Establishment and Responsibilities of the Inter-State Council: If the President believes that creating a Council would benefit public interests, the Council will be responsible for:
    • Examining and advising on disputes between States;
    • Investigating and discussing issues of common interest to some or all States, or between the Union and one or more States; or
    • Making recommendations on these issues, especially to improve policy and action coordination.
  • The President can establish such a Council by order, defining its duties, organization, and procedures.

Composition of the Inter-State Council

  • Chairman: The Prime Minister of India
  • Members:
  • Chief Ministers of all States
  • Chief Ministers of Union Territories with Legislative Assemblies
  • Administrators of Union Territories without Legislative Assemblies
  • Six Cabinet Ministers nominated by the Prime Minister of India

Procedure of the Inter-State Council

Structured Procedure: The Inter-State Council (ISC) follows a structured procedure to ensure efficient and effective discussions and decision-making

    • Presidential Order and Guidelines: The Presidential Order outlining the ISC’s guidelines stipulates the following procedures:
  • Issue Identification and Guidelines:
      • The ISC establishes guidelines for identifying and selecting issues to be brought before it. This ensures that the council focuses on matters of significant importance and relevance.
    • Meeting Frequency:
      • The ISC convenes at least three times annually at convenient times and locations determined by the Chairman. 
      • This regular schedule facilitates ongoing dialogue and collaboration among the council members.
    • In Camera Meetings:
      • To foster open and candid discussions, ISC meetings are held in camera, meaning they are closed to the public. 
      • This confidentiality encourages members to express their views freely and without external pressures.
    • Quorum:
      • A quorum for an ISC meeting is constituted by the presence of the Chairman and a majority of the members. 
      • This ensures that a sufficient number of members are present to make informed decisions.
    • Consensus-Based Decision-Making:
      • All decisions at ISC meetings are reached through consensus
      • This approach promotes unity and ensures that all members are in agreement with the council’s decisions.

The Inter-State Council’s Mandate under Article 263

The Inter-State Council (ISC), established under Article 263 of the Indian Constitution, plays a pivotal role in fostering harmonious inter-State relations. 

    • Its mandate encompasses three key responsibilities:
  • Dispute Resolution:
        • The ISC acts as a mediator in resolving disputes between States. 
        • It investigates the issues, facilitates discussions, and provides recommendations for amicable settlements.
  • Collaborative Policymaking:
        • The ISC serves as a platform for discussing and investigating subjects of common interest to multiple States or the Union and one or more States. 
        • This collaborative approach ensures that regional perspectives are considered at the national level and leads to coordinated policy decisions.
  • Policy Coordination and Recommendations:
      • The ISC makes recommendations on various subjects and issues, aiming to enhance policy coordination and streamline actions between the States and the Union. 
      • These recommendations promote consistent and effective implementation of policies across the country.
